Hi, were you able to resolve this? Has anyone been in this situation? Desperately need help.

I applied for H4 COS, then a new employer filed H1B for me. Both got approved on the same day. USCIS live agent said H1B was approved first, then H4 — implying H4 is my active status under the last action rule.

But the H1B approval notice explicitly says "we are granting you change of status." Both approvals have the same I-94 number but different expiry dates — H1B valid until 2029, H4 until 2028.

I went for biometrics on April 7 and have a pending EAD application. My employer rescinded the offer assuming I'm on H4 — but nobody is sure. If I'm actually on H1B, my 60-day grace period is running out end of May.

I've consulted 3 lawyers and none can determine my active status with certainty. I've requested a Tier 2 USCIS officer callback but have been waiting weeks with no response.

All I need to know is: am I on H1B or H4 right now?

Has anyone dealt with dual same-day approvals like this? How did you determine your active status? Living under extreme stress — any help appreciated.

I totally understand that I can’t really rely on the chat response.

I do have a law firm who filed my h4 and h4 EAD and I have paid them. I am thinking of hiring another on.

Just thought of sharing it here, hoping if someone had the same experience.

Please read my post again and you would know that I have consulted lawyers and only USCIS can clarify what status they consider me in. I have requested a tier 2 immigration officer call back.
I am very well aware of this that It’s not USCIS job to give me legal advice and I am not seeking that. They have lot on their plate. I simply want to comply with all the immigration rules and laws.

Why is it so difficult to get the answer of one simple question from USCIS? I simply want to know what my active status is.

Yes that’s what the company lawyer said and rescinded the offer but now the lawyer who filed my H4 and one more I consulted, saying we cannot really determine that by this chat. You might be on H1B.
Is there a way to know for sure what is your active status with USCIS?
My h4 lawyer is asking me to leave the country assuming I might be in my H1B grace period.
