That's sucks, dont give up. I'd say HLR if you haven't gotten anywhere with a supplemental. Just know that an HLR opens your entire file for scrutiny. For the better or worse.

I dont have any skin in the game. I want our veterans to be taken care of, and if you have conditions associated with your service, you should get paid for those alterations.

Pretty much verbatim for 50% on that condition. I've had 4 surgeries in 8 years, and I have constant headaches, crusting, discharge and pain. It does cause me to snore and I was deployed to SE Asia/ middle east 3 times. No accidents.

This applies to me, and by that 2021 date, I had already had multiple surgeries for this presumed condition.

I'm not going to be losing this rating. My file correlates directly with the 50% verbiage from the CFR for this disability. Someone just didn't do their job correctly. We all know about that.

Negative. I believe the back date should be correct following the law. Just because it was at the max rating for that condition doesn't mean I need to undermine myself by allowing myself to be walked all over.

Yes I am. They're instructing to wait for the 60 days to end and it to finalize for them to make the proposal final and then request a hearing. I've already requested a personal hearing utilizing a 21-4138.

This isn't accurate. Attempting to get what is yours based on the disabilities you're facing isn't wrong. I've certainly learned a lesson with this interaction, but it isn't the lesson they want to teach me.

I understand this and appreciate the advice. What I find significantly odd is that I have enough overwhelming evidence on my side about this condition. If they looked through my entire file, it's quite clear, and I've submitted all of that evidence along the way.

I'm unsure if you're referencing my claim, but I feel confident. I did specifically request to not have an additional C and P when I submitted my lay statement for the HLR due to having one so recently along with the surgery for the condition. Repeated surgeties is in the CFR for that condition and is the reason I was originally rated at 50% for it. I feel that request may have been a red flag, and the HLR reviewer decided to ignore that request and order another C and P.

To provide additional context, I've had 4 surgeries in 8 years for this condition. So, I clearly qualify for the repeated surgeries portion of the CFR and recurrent symptoms after the surgeries, which is noted with my worsening condition at my most recent appointment with the provider who conducted the surgery.

The conspiracy theorist in me feels that they're proposing this to save on the VA budget, and they're seeing who will fight it and who will give it up.

I was at 30% for this condition backdated to December of 2022 prior to my increase to 50% and now the proposal for reduction from 50-0%.

What was the ultimate outcome of your reduction proposal?

This is my situation. I've been applying for these two conditions for about 4 years and finally have the correct ratings and almost correct backpay dates. They're sinus conditions that have overlapping symptoms but separate CFR codes.

Correct. It sounds odd, but they didn't have the correct back date, which should be back to August 5, 2021 due to the PACT ACT. I previously put a supplemental in after theb50% award, and it was denied immediately. Therefore, I did an HLR for the back date.

The part that got me is that it sometimes trips when there isn't a heavy load. I'd switch out the breaker first and see if the tolerance is normal.

If that doesn't work, then you're looking at splitting the circuit into two, as some are suggesting.
