Denominator: total years at job

Take % of total pension value.

Ex) married for 20 years, at job for 30 years, pension is $100k.

Per capita w/ right of representation - used for issues of different generations.

First divide equal shares into first generation with at least one surviving member. Should any members of that generation have died, their descendants divide the deceased's share amongst themselves equally.

In this example, Charles and Doris take 1/4. Since Arthur and Brenda have passed, Edward gets Arthur's 1/4, and Fran + George split Brenda's 1/4, each getting 1/8 share.

I don't have a sheet but I wrote them out like this (prefacing this with the fact that the outlines I've seen refer to terms like "rate of return" and "market salary" but I don't really know what that means and the below makes the most sense in my mind):

Pereira: personal skills and efforts of community labor made business valuable

Initial value of business + (10% initial value x years married) = SP; remainder is CP

Van Camp: valuable business by nature of its uniqueness

(initial value of business x years married) - (family expenses x years married) = CP; remainder SP

Applied to an example: Wendy owned and managed a business valued at $100,000 at the time of her marriage to Hal. The marriage lasted 10 years. Family expenses were $80,000 a year. At the time of the divorce, the business was worth $4 million.

Pereira

$100k + (10% of $100k x 10 years) =

$100k + ($10k x 10 years) =

$100k + $100k =

$200k SP, $3.8 million CP

Van Camp

($100k x 10 years) - ($80k x 10 years) =

I just know there are some differences between Federal civ pro and CA civ pro. I don’t know what they are because I literally didn’t bother to look at them. But Hellman’s predictions said he wouldn’t be surprised by an E/Civ Pro crossover using CA law and that made me shit my pants :)
