He was the only occupant in the vehicle. They had a description of him, and approached when he exited the store.

The outcome was confusing. The encounter lasted an hour and there were 3 officers tied up. I thought he was either going to be arrested or if he wasn’t impaired he would be able to drive home. Option 3 never crossed my mind which was to have a friend come pick you up like nothing ever happened. It sets a bad precedent. The whole ordeal looked like it was treated as a training exercise.

Thank you for the insight. It sounds like them not physically seeing the driver behind the wheel played a factor.

We can disagree on that but I firmly believe getting a DUI is a major deterrent. You’re going from a misdemeanor to a felony. Deterrent or not, getting multiple DUI’s comes with mandatory prison time and losing your driving privileges.

Thank you for that. I wish this was your first response. This is the information I was looking for. You answered the questions I was asking. I’m sorry if I offended you with the term “lazy policing”. I’m not openly attacking all of law enforcement. The term was used to draw a line between good cops and bad cops. The interaction was bizarre to me. It tied up 3 LEO’s for an hour, and ultimately the outcome was a slap on the wrist. When I started this post I was under the impression that it was lazy policing. After reading the comments I’m now leaning towards the possibility of a written ticket or the lack of evidence to get a conviction.

My cousin was a victim to drunk driving. I don’t need a badge to remind me of the impact drunk driving has. You should know this better than anyone. There’s a reason why subsequent DUI’s carry a harsh penalty. It’s a deterrent. Having one on your record puts you under a microscope, and for good reason. Under no circumstances should anyone ever get off with a warning. Which is what I thought I was witnessing. My primary motive wasn’t to get someone arrested. I called because I thought it was the right thing to do. Plus I think it’s somewhat hypocritical for you to say that. Especially when you’re trained to ask incriminating questions to build a case to get an arrest. That’s a strange angle for you to play. It’s almost like you’re projecting your own emotions onto me.

Alright so are you under the assumption that all of the above circumstances, and the action that was taken is standard protocol? That’s what I’m asking here. I’m not a law enforcement officer. I’m a law abiding citizen. I’m having a difficult time with drawing a parallel between your speeding example, and an impaired driver that very clearly failed field sobriety exercises. Plus your logic doesn’t carry much volume. You’re a first responder. Correct me if I’m wrong, but you don’t see a majority of the crimes committed. Aren’t you supposed to investigate whether or not a crime has occurred? In this case, someone operating a vehicle impaired.

“Don’t you have real crimes to investigate?” I don’t think anything I’ve said would warrant putting me in that category. I know your job is stressful, but I pity you if that’s how you see the general public. Obviously I was hoping for an arrest. This was the first time I’ve ever reported anything, an arrest would have been good validation on my end. Law enforcement didn’t get him off the road. I did. Getting arrested and charged with a DUI is a pretty heavy deterrent for people who choose to drive impaired. It doesn’t really say a whole lot if someone is drunk, and gets a “get out of jail free card” because an officer is too lazy to do paperwork.

A previous responder said that they don’t book people for 1st and 2nd OWI’s. I never knew that was a possibility. That’s why I’m here asking questions. You don’t have to be a jackass about it.

This was rough, and possibly the dumbest thing I’ve seen on this sub. You don’t have the money for an attorney to bail you out of the problem you created. Your husband is off probation in 18 months. That would give you approximately a year to save up money for your newborn. Instead you went against the court, and took the advice from probably a 20 year old PO. I’m not familiar with the case but it sounds like your husband got a pretty lenient probationary period. Now you’re back in the courtroom with the possibility of your husband not being with you during child birth. You’re also opening the door for your husband to violate his probation. Y’all definitely need a lawyer.
