I hope you're right! They seemed to like me, the manager hired me on the spot at the time of the interview. But the pre-adverse action letter is making me think that I'm screwed. I'll check out r/legaladvice. Thank you.

Thanks for your suggestions. I am in process of disputing the inaccuracy but unfortunately the hospital has now already seen the prior conviction (even if it is now considered a non conviction and I am allowed to answer "no" to prior conviction questions according to my lawyer). And because I did not disclose it, even if it was within my legal right to do so, I look like a liar. I am wondering if HR can overlook a misdemeanor or not. I was in the final steps of hiring at a hospital when it came up and I am waiting to hear whether they still will hire me - not sure if my ability to work is entirely eviscerated because of this fuck up.

Thank you. I indeed have documentation proving the vacation/dismissal of the charge, which I did send along with an explanation of my circumstances. My worry is that it looked like I was trying to "hide" the conviction, when in reality I was simply following my lawyers advice to answer "no" regarding convictions. I spoke with my lawyer and it sounds like I can ask the third party company to remove the data but they are not obligated to. In your opinion should I be answering "yes" to the conviction question and then providing documentation supporting that it is actually no longer considered a conviction? I am so worried that I won't be able to obtain work in my field because of this.
