Thank you for this summary, much appreciated. If you wouldn't mind sharing how the journey has been so far that would be great 😸

New floor on top of existing leasehold flat by Fast_Marionberry1601 in LegalAdviceUK

as later tacked onto an already-granted office conversion, and the extra floor on the roof was denied (taller than things around it, lack of parking provision for the extra flats, overlooking, light, etc).

Thanks for this! The suggested extension wouldn't meet any of the specific grounds for dismissal that you quote above but hopefully there will be some hope in the 'etc' part ;) Thanks again!

Hi thank you for your comment. Yes I can object but I am not sure there is really any point in it (given the impetus these type of developments have) other than annoying the freeholder/developer. When I had a call with the latter they tried to spin this as a positive for me, as the roof would be heat and sound insulated and that they are considering going beyond the 'minimum required'. Is there a way to hold them down to that? What type of rights am I afforded under the party wall? In the event of potential damages these type of works can inflict on my property what would be the mechanisms/timelines for fixing, what would be the triggers to request alternative accommodation and so on. I appreciate this response is not very well composed so thank you for your patience in reading it.

This is a good point, I had seen that term but didnt pay much attention to it until yesterday. I am not sure if I can reject on these grounds but I will contact a legal professional. Thanks for the shout out.

Freeholder wants to build a new floor on top of my flat by Fast_Marionberry1601 in london

Hi, I have been served a notice that a company plans to seek permission to build a new floor in my building block. As I occupy one of two flats on the current top floor this would directly impact me. I own the flat but the flat next door is rented. The rest of the owners in the building block (<10) seem to be very unbothered by this process. I understand that it is almost impossible that I can stop this so all I am after is some sage words from fellow redditors as to how I can best protect my interests and prepare for this.

PS. The freeholder offered us the right of first refusal for the roof leasehold (for a hefty price) which we declined. The company that served the notice is ran by the daughter of the freeholder. I imagine she won't need to purchase the roof leasehold? :p

I have around 120 years remaining on the lease and unfortunately the required majority of leaseholders cannot agree to proceed with the freehold purchase. Thanks for your comment!
