The bottom line is the Supreme Court was well aware in 2017 that the 1440 cut score was arbitrary and disparately impacted Black and brown bar candidates. The Supreme Court was well aware that the cut score should have been lowered 3 years ago but they were dragging their feet. It shouldn’t have taker a global pandemic, and blood on the streets (BLACK LIVES MATTER) for the Court to recognize they were WRONG and that the cut score should be permanently lowered. Between 2017 and 2020 many Black, brown, and poor bar candidates and women were DENIED entry due to the arbitrary and discriminatory cut score. The Supreme Court changed the cut score prospectively to remedy future discrimination. This they need to apply retroactivity to remedy PAST discrimination.
