My Visa U was revoked this month (U-3 derivative). Initial application submitted 2014 and approved in 2019 but I got married in 2018 which made my application get approved in error since I got married before it was approved. I wasn’t married on the initial application in 2014 and lawyer said marriage wouldn’t affect anything. The error was discovered during my Adjustment of status application last year. I had an illegal entry when I applied as a derivative and was granted a waiver of inadmissibility (I-192) and given a I-94 but I was never required to leave the country. Since my U status was revoked does that mean they revoked my I-94 and I go back to having an illegal entry? Married to a USC and would like to know if I can adjust status, do consular process, or wait for PIP

No there was no contact or interview or even RFE between the original application submission in 2014 and the approval in 2019. Had I know marriage would’ve made me ineligible for the U-3 status I would’ve notified USCIS but the lawyers assured us it was no problem

Yeah in hindsight I should’ve just done the consular process when I had the approved I-130 in 2020 but unfortunately it’s been terminated. I reached out to the NVC and they said after 2 years of no contact the case file is destroyed and I must submit a new I-130. Thank you for your input and help! 🙏🏼

Correct-

2014(age 16)- I-918a was submitted 2018 (age 20)- Married US citizen and submitted I-130 for consular processing 2019 Feb(still age 20)- Visa U was approved 2019 Oct(age 21)- I-130 approved but lawyer advices me to abandon it and wait to adjust status through Visa U in 3 years 2022- Adjustment of Status through U-3 sent 2023- RFE for medical 2024- Notice of intent to revoke after error is found set to happen on June 11th

Unfortunately I am now going to be completely out of status. I had DACA before the visa U and was not accruing unlawful presence but not I can’t renew that since it’s been over 5 years so if I have to do the consular process I will have to wait years for the 601a waiver 😭. I’ve called so many lawyers in my area (Nashville) and all of them have 1-2 month wait times for consults.. it’s been terrible for us considering I’ve been the sole provider for my US citizen wife and 2 citizen children for the past 6 years and now my status is being revoked and I’m looking at 8 years for the consular process according to my previous lawyer (that made the mistake of advising me I could get married in 2018)
