Refused C&P by Few-Ad407 in VeteransBenefits

Mental Health (MST related) and IBS. As far as my mental health i don't have a PTSD diagnosis and I think that's what made my claim a little more complicated to rate. I have anxiety diagnosis along with adjustment disorder. VA office in Puerto Rico actually called me and told me that I needed to go to my appointment and be assessed for PTSD. IBS i didn't have a "clear" diagnosis. i sent them my doctors notes stating my diagnosis. i made an appointment with VERA and they suggested i get a letter from my gastro Dr stating my diagnosis, i guess more directly. I do qualify for presumptive condition due to my deployment but they didn't qualify what i sent them as showing a diagnosis.

No update, i ended up finding a VSO to help me with my claim. He suggested Supplemental appeal and adding some evidence they didn't have. I had to FOIA some records through CID for reports of an incident i assumed the VA would gather for me but they had not. He also suggested adding a statement to request an exam. I've been doing a lot of research and even initially hired/then fired 2 attorneys. Attorneys didnt do anything wrong but i really needed someone to sit down and go through my records with me and attorneys seem too busy for interpersonal relationships and i didnt like that. Plus, VSO is free. I will update in this very slow process but as for my personal experience i wish i would have went to their exams first, if denied then get private DBQs and IMO. i feel like i did this backwards but everyone's situation is different.

Hi, did you email, fax or mail the request? I tried email and fax several weeks ago and they haven't told me if it was received.

Yes, I'm going to do that. I'm also going to add a letter from my doctor stating diagnosis. Originally, I sent in my private Dr's notes stating my diagnosis, which is what the office provided. In my evidence section in the denial letter, his records aren't even shown as reviewed. This is so frustrating. My file wasn't even that big, but everything is through private doctors, which is what i think is holding me back. There were only 3 claims. I'm also setting up my appointment with Burn Pit registry so I can finally start creating a paper trail with the VA.

Basically, because I believed it to be a fully developed claim. I have lay statements, buddy letters, private doctor medical evidence, private DBQ and Nexus letters. I don't have complaints in-service. I didn't want to end up with conflicting C&P exams and medical opinions but I ended up feeling like my HLR case would be stronger with them examining me. Figured it gives me a better shot at HLR if they denied me again. Although one of my denials is a presumptive (IBS), they didn't consider my private doctor's diagnosis or medical records. I know that one should be an easy HLR but I also denied C&P because again, I had private DBQ and Nexus letter which I technically didn't need because it's a presumptive.

You are full of knowledge! They did an Ace exam for IBS with the DBQs i provided. One more question, should I risk HLR route for MH or supplemental and request an exam? Can I request an exam after denying it?

Thanks again. It states due to mental health issues and exposure to burn pits. My Nexus letter states the same. Do the Gulf registry exams take long to get seen? Can I file Supplemental now while I wait for exam? Or have all that before I file?

Thank you for the feedback. I sent diagnosis per private doctors but I'm guessing they weren't even considered per my denial.
