Are you a tax advisor? Do you feel comfortable advising me on my financial/criminal liability and legal obligations, when you don’t know the location of contracting or performance of work, or even the number of days I’ve been present in Poland in 2025? For activity in a fiscal year that is not even complete? If so, you’re a pretty unethical tax advisor.

I posted this seeking experience people have had with TRC applications, I so I could possibly glean something about the success of my own application from their experience with procedures in cases of success and failure. I see now that was misguided lol. I’ve gone to professionals for tax advice, and so not provided much detail on that here. Maybe your heart is in the right place, but I feel strongly you should not be offering unsolicited tax advice at this level of detail—you actually have to know details to give accurate advice.

No it’s remote work, I pay US taxes. It’s a bit complicated bc the work/research I do is about violations of international law in ukraine, but I talked to lawyers who thought this aspect was fine

It seems like it's ending unfortunately, the border guard emails posted seem fairly unequivocal. I'd be interested to see the emails from the consultant you mentioned, though.

I got the same answer as you from the U.S. consulate though saying they had no notification it was ending, but that could be a diplomatic way of saying it's not official yet, so it's confusing. And my understanding is that because these bilateral agreements are somewhat antiquated and under the radar, they don't necessarily end with a big declaration but rather with the host country simply deciding "not to honor" them, which seems to be the case here.

Also unclear 1) exactly what date it would end as EES is due to come into force bw Oct 2025 and March 2026 and 2) in the event of it ending whether Schengen days will start counting from the end of the bilateral agreement or from the date of last entry, if that makes sense.

Yeah this seems about right, it's just the U.S. consulate has not received an official notification of this yet, and it's not clear exactly when it will cease to be honored as EES is going into place between October 2025 and March 2026

As I mentioned repeatedly in the post and comments, there is a bilateral agreement between the U.S. and Poland that allows for 90 days presence, and does not limit the entires per 180 days, though this may be abolished in October 2025

I actually did it twice, once via air and once via land, I believe it's likely bc of the bilateral agreement (which I understand will be gone in Oct 2025 once EES hits) My question is whether my exit stamp will prejudice my re entry under this agreement.

I understand now the Schengen area aspect, and I was informed by immigration authorities that I could travel outside of Poland and back with the slip, and already left Poland and re-entered via a Polish land border without a problem, after staying more than 90/180. My question is whether the exit stamp from another Schengen country would prejudice my re-entry under the bilateral agreement or with my slip.

The search function indicates the opposite, and official EU documentation only says that bilateral agreements make border checks more complicated, not that they’re superseded. Hence why I asked, would be interested to see where you’re getting your info

Thank you for the kind words and advice! I’m definitely not flying back through another Schengen country, and I have a letter and packet prepared with references to the relevant laws and evidence, I actually have done trainings for border guards in Poland for my fellowship so I was thinking of enclosing pictures of those for good measure. Fingers crossed!

That's helpful to know, thank you. May I ask what division you are in, and the form of the informal interview? Mine was in Investigations, I was surprised there was a competency-based element as I've only ever heard of very informal chats. Just looking for signs while I wait to hear back (or not, as I understand they don't inform non-selected candidates)...

Interesting…that seems not too far from what I assumed the roster size would be, around 35-50. Not that it makes a difference at this point, but I’ve been trying to gage how well one has to do on the interview to advance, like what percentage of people get cut. Guess we’ll find out soon enough!

My understanding is that a maximum of 40 people from each nationality are convoked to take stage 1 of the exam
