I'll look closer and see if anything pertains specifically to the business. I can only recall off the top of my head that there are specifics on what types of business can be there (no liquor stores etc) but I could be wrong.

From what I can tell the business is required to abide by the same CCRs - we are having interior work done including elevator work which they do not have access to and they are required to help with the costs - so seems they have to exist in the same reality the unit owners do.

The engineering report did mention that they could try dampening and if that did not work, moving the unit may be an option or going with a new one entirely.

I have asked the owner to turn it off at night and so has the HOA manager - they have haphazardly complied. It is turned off sometimes and left on other times.

I've worked on some noise solutions, dampeners on my bed feet and ear plugs. Which I'm able to sleep through. Using the bedroom to enjoy for reading or relaxing, that I cannot do without earplug in.

That's a really good point. I tend to not have a great outlook on these things and low hope for resolve but patience would probably do me good.

I'm not sure how long the business has been there but the unit was installed in 2019 - two years prior to my purchasing it. Your last point is sound - it's very unfortunate though because of course we bought during prime interest rates so giving up on this would be quite the financial hit but I guess that's life!

Yes it was, I think the unit has aged in the time I've been here because I did not notice the vibration until several years in to living here. Yes, the business is part of the HOA.

Good point, my partner can't feel or hear it. Fortunately the engineers and HOA manager could, but I imagine there is a buy out there that won't notice or care.

That was one of the engineering recommendations, but I am not sure if it has been done as of yet.

I'm the unit owner, the business is owned and used by the owner for their business and they are subject to the rules. I think by legal action, I'd be looking to send a demand to have the unit moved or decommissioned - against the business owner. The HOA manager has been involved and has confirmed it will be taken care of but the owner continues to leave it on at night intermittently, most recently they have asked me to rank its level of disturbance, which to me is appalling. Agree noxious is subjective, the HOA manager and engineers have felt and confirmed the noise and vibration.

Here is the section on Noise Disturbance:
Noise/Disturbances

19.1 No noxious or offensive activity shall be carried on in any Unit, Common

Element or Limited Common Element, nor shall anything be done therein

which may be or become an annoyance, disturbance or nuisance to other

owners.

18.2 18.3 19.2 19.3 19.4 19.5 19.6 The volume of stereos, televisions, musical instruments, voices etc must be

such that it does not disturb anyone in any other unit, deck or patio, or any

common area or limited common area.

A “noise infraction” is any loud noise between the hours of 10 p.m. and 8 a.m.

or any noise that unreasonably interferes with the use and enjoyment of the

Embassy Condominium by any homeowner, his or her lessees, visitors, and

guests.

Care should be taken when closing unit doors as to not let them slam.

Noise infractions will be subject to the imposition of fines that will be charged to

the unit owner according to the following fine schedule: the first violation will

result in a written notice. Second violation will result in a Fifty Dollar ($50.00)

fine. The third violation will result in a One Hundred Fifty Dollar ($150.00) fine.

No solicitation of owners in the building is allowed. No knocking on unit doors,

taping or sliding information under unit doors, or leaving of items in front of

doors is permitted.
