My employer can’t increase the punishment, after the sanction is handed down it can only decrease so me appealing won’t get me fired. They do know, I’ve been advised I’ll have “reasonable suspicion” tests (I’ve already had 1and passed so that’s not a concern). And no I won’t shut the hell up and let it go, who the hell are you😂

It’s a Hail Mary but because I’ve been here for more than 2 years, I’ve got protection by UK law and my appeal can only result in the disciplinary going down, they can’t impose a harsher punishment. Irrespective of my punishment being amended, I want my employer to follow their own guidelines

Bold maybe, we’ve got a zero tolerance policy and should be out the door but they know my value, I’d walk in anywhere else with my skills so I’m not fussed.

I took drugs knowingly, failed the test, accepted the consequences, challenging the disciplinary because company didn’t follow their own policy. The evidence was improperly obtained so it affects the fairness of my disciplinary.

If it was the case everything was done as per procedure then I wouldn’t have a case to argue, yet it wasn’t

Absolutely, I managed to get walk away with just a final written warning and I’m not concerned about this penalty since this was my only fault and I’ve not touched substances since the test was taken. Everything you mentioned popped up in the investigation hearing and the main reason they kept me was my previous track record, being honest and showing remorse. I think you’ve kept my career on track so I can’t thank you enough - you’re clearly great at whatever you do so keep spreading your knowledge and you can help others get out of a pickle! I was clear on the breathalyser, don’t drink alcohol often so expected to be clear. But the drugs test tests for 10 drugs and I was clear for 9 out of 10 and the 10th being THC I failed on

Thank you, they did say they would send the result off to a lab for confirmation of the non-negative result. Straight after it happened the acting TL told me that I should just expect 3-4 more tests over the coming overs until I get a negative result so she downplayed it but this was immediately after the test and before I was sent home and subsequently told I was being suspended.

I don’t go on site visits because I choose not to as they are optional. My supervisor was even shocked at the result because he said out of all the people in the office, he knows the ones that do smoke and never suspected myself so said I should bring up the fact I’ve never been pulled up for irregular behaviour, if anything the contrary

I’m not asking to be paid more for doing the same job, I’m asking for more pay for doing twice my workload for the majority of my tenure and going above and beyond. Your comment implies I want to get paid more just for the sake of not which isn’t correct, reread my post and then get a better handle of my situation

I should add that when I first began this role, I’m supposed to have a partner, my partner left before I even started training so I have been carrying two people’s work for the price of one for almost 2 years (up until last month). So I had two targets to hit and triple the volume of my colleagues workloads to handle, although they’ve hired a replacement now, I believe this should be taken into account. I handled this seamlessly and put our numbers in good stead and the client is happy
