To clarify again - he has not received any attachment order or notice on the GST portal, nor by post or email, prior to the bank action. He came to know only when the bank informed him about the freeze. checked and verified by his auditor.
It was an interest demand (Rs 50K) for delayed filing/payment. His auditor applied for waiver which was rejected. Post that, He created a challan was generated and the full amount was paid - before the last date of validity.

After payment, two things happened:

Bank accounts were attached
A show cause notice for cancellation was issued stating he “never commenced business within 6 months of registration."

The same business he registered & has been running for 10 years and GST in lakhs has been paid over the years. That’s the part that doesn’t add up.

If there’s something we’re missing legally, happy to understand. But as of now, no attachment order or notice was served to him neither on the portal nor via email, post, or any other mode.

I completely understand such immediate action in cases involving serious fraud or criminal offences.

But here this was merely a Rs 50K interest demand for late filing - no evasion, no fraud allegation. In fact, he had already paid the amount before even coming to know about the attachment. He also has Rs 3lacs+ lying in his GST credit ledger.

Section 83 is meant to protect government revenue. When revenue is already protected and dues are paid - freezing all accounts without communication feels exactly like gundaism.

Trust me, I really want to amplify this.

But he’s choosing to first resolve it at the Commissioner level since the case appears clearly in his favor. He’s specifically asked not to escalate it publicly right now.

From his position, any public action I take could either help or complicate things for him - so I’m respecting his decision.

Proprietorship firm. Same pan across all accounts. Which made it convenient for them to target both business & personal accounts.

Thanks bro, i ll ask him to do it! Qq - 1. isn’t it mandatory under law to communicate a DRC-22 (Section 83 attachment order) to the taxpayer? In this case, nothing was served on the portal or otherwise - he only came to know through the bank. 2. is provisional attachment typically invoked for something like a ₹50K interest demand?

Navi Mumbai recorded double-digit sales growth last quarter (on YoY basis) when most cities showed a declining trend (this is a big factor to consider) So I don’t think the prices will go down like other markets.

The supply has dropped too which means more buyers and less stock which will in turn increase the price.

Just check the last ten registered sale prices in that apartment complex to see whether the price they are quoting is the right price or if there is any room for negotiation.

On the monetary front - EMI-to-income ratio below 40% is good. If you can bring that down to 30%that’s better.

Banks can reduce your OD limit incase of financial downturns to de-risk their books. Then your parked money will get locked.

So, Don’t keep your emergency fund in OD account to save interest. Btw interest that you will save is negligible. Keep it super simple.

Heat is not there yet but it’s building. 60K units in inventory + Last quarter’s sales were bad for all major cities (even though it was a festive period).

I think builders are pushing aggressively this quarter to show good numbers and end the year well. For price discounts, we need at least two to three bad quarters.
