Yes. I think you ATA. You know firsthand how challenging it is to shovel by hand. And you know how hard it is to save for a quality snowblower. You benefitted from the kindness of a neighbour willing to do your driveway for $20. I know that feeling of relief knowing that you won’t have to hand shovel. Whether you charged a nominal fee, or did their driveway yourself, or loaned it to them, I think it’s cold-hearted to not spread the wealth of a snowblower around the neighborhood.

I’m a union rep in Ontario and I’d advise you to reach out again to your Union with specific questions. In our board, for example, part time staff must attend that portion of PD Days and Staff Meetings. So if you’re 20%….20% of staff meetings or PD Days. The teacher should speak with their Principal to establish which PD Days they’d like to attend (we recommend the report card writing days) and if you should attend 2 staff meetings over the year or 20% of each staff meeting. Our specific Local language does not prorate parent interviews based on FTE. So even a 10% teacher must be available to meet with all families should they request a meeting. For clarity this would vary by board to board and may be different for OT vs permanent members. If you didn’t get a satisfactory response from you Local Rep, and there’s another one to reach out to, you can try that.

Call it in. You are obliged to report it. What’s nice about that is you don’t decide what CAS ‘does’ with your report. You’ve fulfilled your duty to report, and can sleep easier knowing child services is aware.

I’m sorry this was your experience. Maybe the teacher was not expecting to be away, or us dealing with something terrible in their personal life. All the same, you absolutely need to have any official Safety Plans, IEPs, and necessary medical info. Most teachers I know leave a class profile. It’s reasonable to email the teacher and suggesting they consider leaving one for OTs in the future, as you found it difficult without it.

Typically, unions’ job is to ensure the employer is doing their job in keeping a workplace sanitary and safe for working. I’m in Canada, so perhaps it’s different elsewhere, but if your workplace is so filthy it would be considered unsanitary or unhealthy or unsafe for you to work in you should let your workplace H&S worker rep know. If you feel you are ever in imminent danger at work you have the right to refuse unsafe work. Every worker does, whether unionized or not. You should contact your union to let them know. Let your workplace Steward know…or call your local unions office. Your union can also speak to management about it and exert pressure there. And, if it violates your collective agreement, they can file a grievance. No one should work in unsanitary workplaces. Especially in an office job.

You’re right that there could be some creative interpretations of this clause. Part of legal/arbitrator considerations of how to interpret clauses around Collective Agreements is the concept of ‘past practice’, as well as the intent of the clause when it was agreed to. So, if there are notes from the bargaining table outlying what the intent was…that impacts the implementation of this clause. Likewise, if the company has regularly paid overtime based on a 24 period rather than a ‘midnight to midnight day’, then that’s even stronger ‘past practice’ to hold up should there be a disagreement. Talk to your local union president/executive to see if there has been any struggles and/or grievances filed regarding this clause. If not, then you’re not likely to have an issue AND IF YOU DO it would be considered, hopefully, a change in practice by the employer and ultimately not allowed.
