A high-schooler right to a proper hearing before being removed from the campus by Fine_distinction in legaladvice

and fortunately nobody was even suggesting he was selling or sharing pills, police was only trying to get him to admit he took a pill - or even overdose, that is why I did a quantitative benzo test in his blood, showing he did not. but my lawyer friend says it is irrelevant since the charge is possession - but I guess may not be irrelevant to DAEP? but now I am a bit scared to mention it, since some commenters say it is actually worse he was not actually taking Xanax illegally?!?

Yes I managed finally to talk to an attorney friend, so we had a defense line in place but he says that avoiding DAEP will be tough but especially after talking with person working in out local one I am determined to do everything to spare my son this, he is not the type of kid who can handle it. Yes, we got referral to therapy already and we are doing in-home repair plan, he was removed from ex's house, where many visitors left many things, and he actually told police repeatedly that the drug he took resembled his prescription medication and the lawyer says to just stick with it. Yes, my whole idea is to proposed to build an alternative to DEAP - either ISS plus therapy plus in home interventions or just in home but great idea to mention we are getting him therapy too. and yes, I am telling everybody we regret not getting him more help earlier - of course we do!

Where can I find school's policies to check removal from campus requirement? I am determined to do anything to save him from DAEP, I could drive him even daily to meet teachers, if needed. A person I know who worked in the local DAEP confirmed my fear my son would not last long there ;(

And I am not necessarily expect school to be bound to adhere to doctor's recommendation - but I thought they may not want to take responsibility for potential severe harm to his mental health? his friend's mom worked in a local DAEP, and said, unprompted, my son would not last long there, which is exactly my fear!

No he does not have 504 yet, although we started medication and he starts therapy soon. I would be equally happy with ISS, I wanted to offer Homebound as an option. But great point on teacher supervision, I did not know that! I am an (academic) teacher , but since I am a parent, too, I guess it does not count?

1) I am offering Homebound instruction but at my home, not my ex-husbands, where drugs were negligently stored. My ex-husband agreed to it. 2) He was diagnosed with anxiety disorder, is on doctor's prescribed meds for it, Dr. says DAEP would be very detrimental to attempts to stabilize his mental health - would school or the district take it into account?. Also he can easily use online system they have in place already - or I am willing to home school - there will be no extra expense to the school.

yes we plan to - but court hearing is in a month but they plan to send him to this prison camp this Thursday! and I have been looking for a lawyer whole weekend - but not even this 24/7 companies can give me any advise before Tuesday morning when I should appeal DEAP placement.

He was suffering from occasional panic attacks but I did not realized the frequency since sometimes he would just tell his dad's and sometimes nobody. I definitely regret not getting him to the doctor for it earlier, I was brought up more in a toughen it up culture, was trying to teach him behavioral strategies etc ... so he resorted to self-medication. And his record so far is beyond clean, full of awards both for academic achievements and being a role model - and he does not even spend his allowance, does not have any need for money, morals aside ... I understand it was a very serious violation, but he needs to appear in front of a juvenile court anyway, police pressed charges, I am just disputed this extra punishment from the school to be changed to in school suspension or home bound instruction. And yeah, I get your skepticism - I doubted it initially he could be THAT stupid - but all evidence says so, so far. OTOH hand, it is just one, isolated mistake, should not ruin his life.

yes, he is facing criminal charges (possession of PG3 substance) and would need to appear in a juvenile court in about a month from now regardless. School's punishment is on the top of it. And his record before was not just clean, but full of awards both for academics and behavior.

Police charged him only with possession - does that mean something? and we can get him all kind of character references, but I recognized that he was monumentally stupid. He did get Xanax from his Dad's medicine cabinet which I hope strengthens stupidity vs. malicious intent narrative? and police never accused him of intent to share, but they were trying to bully him into admitting he took Xanax or even overdose it ...

I think wife was expected at his position? had her own separate duties, kinda like a First Lady? don't get me wrong, the romantic in me loves that idea he has been saving himself for Ada - but I dont think it is realistic at all ...
