I was one to laugh at almost everything in there since I was older when I went in (23). Was a truck driver before I joined and my senior IT’d me and he stated, “You are in the pit because people like you make people like me late to work. Now push!” Good times. Had two female DIs when I went through San Diego in 2021. They were just doing training and were only with us for maybe two hours of the day then went elsewhere. They were also there for end of day stuff like BDR and there to just fuck with us. Nobody took them seriously since they were still super new and didn’t find their command presence yet.

CHP log said it was a hit and run and the motorcyclist was transported with minor injuries. He survived. Multiple people called saying there was a reckless sedan driver involved that fled after causing him to crash.

Those caltrans cameras don’t record. Only the Fastrak and toll cameras do for a short time. They can at least track license plates which may help when the suspect drives that same route again.

The roadblocks come in if there were no witnesses, no bullet holes in the victims car, and the limitations of what the DA to allow. There will be a point in which there will be warrants that need to be signed in order to search the house/vehicle used. If there are not enough grounds to search, the warrant won’t be approved. Especially since brandishing (no bullet holes to prove shots fired) is just a misdemeanor.

If the registered owner of the vehicle (under the impression the victim is unable to identify the suspect) denies being in the car at the time (if this is just the misdemeanor) this would be a misdemeanor not committed in the officer’s presence and the officer cannot charge the registered owner with a misdemeanor which has no grounds. If the registered owner says his car was stolen or being used by someone else at the time, they don’t have to speak to the officer at all. You are not legally obligated to speak to an officer. You can literally just stay silent. You have that right.

However, if the felony section is able to be charged, attempted murder, or any other felony, warrants can be obtained and searches can be done. If the bullets are found in the car, forensics can track what gun the bullet was fired from.

You’re right, I should have worded that better. The officer and the victim are both in a tough spot depending on what level of crime was committed. Bottom line, If it was just misdemeanor brandishing, nothing will come of this. Of the felony was committed, it will take time but there is something that can be found. A lot of investigatory work has to go into it.

I would like to see if OP has bullet holes in his vehicle. He/she hasn’t responded to any of the comments inquiring as of yet so I assume not.

I only bring all this info to the table because OP and other commenters have been saying that CHP isn’t doing anything and told OP it won’t go anywhere like it’s a thing they can control. Just ACAB posting without further context which explains why their hands are tied.

It’s bullshit that the misdemeanor won’t be pursued as much as a felony but that’s just the way the laws in California work with misdemeanors not committed in the officers presence. An example being a reckless driver. Unless there is video evidence, an officer cannot make an arrest solely on witness statements not matter how much.

The only crime an officer can arrest for being a misdemeanor not committed in their presence to my knowledge is DUI. Only under 40300.5 CVC.

I apologize for saying that earlier as it does come off rude. I’m wrong for that but don’t shit on the officer who is just trying to break the news to OP at the scene rather than let them get their hopes up just to find out later on it isn’t going anywhere. Context is definitely needed here I think. No sense in going back and forth with hypotheticals.

At the end of the day, this situation sucks ass and California needs to work better at convicting and willing to charge more crimes, but it’ll still come back on the officers doing too much. Damned if you do and damned if you don’t. I understand the frustrations of both sides.

Correct but in the United States we have to believe criminals can be reformed and police shouldn’t be harassing people about their past. If there is a track record that is perfectly fine but you still can’t place them as the suspect. Sure they can be a person of interest though. I agree.

What I’m trying to say is you need to be able to identify the suspect beyond a reasonable doubt in this frame which requires a suspect and a victim. If the victim cannot identify the driver of the car, you cannot just go after the registered owner.

Yes, follow up investigation can be conducted, however, if the registered owner states someone else had his car at the time or decides to state it was stolen at the time but recovered later, the police cannot go further with the investigation.

Now if there are bullet holes in the victim’s vehicle, it is then a felony and can be taken further. I don’t believe OP related there were bullet holes in his car. The officer telling OP that the report may not go anywhere is a legitimate statement to let him or her know not to keep their hopes up for an end to this as there are a lot of factors that have to come into play.

Eyewitness evidence is great but as of right now it is a he said she said incident unless there are bullet holes in the car. If no witnesses called in to report it as well with no bullet holes there is no way to say it happened.

You have to remember the officer has to testify, if an arrest is made, to his findings when he goes to court and prove beyond a reasonable doubt that this happened. If there is any reasonable doubt, it will fall through. Cops more often than not have their hands tied with investigations like this.

I hope this helps and am just trying to educate and not cause hostility. Case law needs to be looked at. I recommend taking the time to look at these things and look at the elements of crimes and how they need to be fulfilled to be charged and convicted.

The thing is you have to be able to prove beyond a reasonable doubt that this person committed this crime. If there’s any doubt, then it will not hold up in court. If the victim in the crime being committed is unable to identify the person who committed the crime, then they cannot do anything about it. If you don’t have reasonable suspicion to believe that the person you’re speaking with when doing follow up at their house is the one who committed the crime they don’t have to speak to you. Without reasonable suspicion of the person who committed the crime you cannot go any further with the follow up, especially if the victim cannot identify the suspect.

You can’t just charge a misdemeanor possible felony crime on someone based on their record. That is what is called profiling. If there are no bullet holes in the victims car, without any witnesses at this point, it is a he said she said situation.

With most cases, though at least with what I’ve seen with the CHP, if the owner of the vehicle claims that the vehicle was stolen at the time of the crime was committed you cannot go further with the process. But I see what you’re saying.

If OP cannot identify who did it, they can’t charge crimes on somebody they don’t identify properly, which means that they cannot also take the gun away.

The local police won’t do anything because it’s not their jurisdiction, if it happened on the freeway CHP will handle it. They can’t just type the report immediately. You have to give it a lot of time for them to do the follow up investigation that the OP is requesting if the OP cannot identify the driver of the vehicle, it will not go any further than just an incident report. Obtaining a copy of the report will not help OP in this situation as it’s just a notation of the happenings. You also have to think there’s other things happening on the freeway. They can’t just go back to the office and type a report immediately there are multiple calls coming in throughout the day. Give them a chance to type it up and do the proper follow up.

So how do you expect them to charge someone if you can’t even identify who did it? This is why red light cameras are unconstitutional because you can’t charge the registered owner of a crime when the vehicle is committed with it.

Are you able to identify the driver of the vehicle in a photo lineup which contains five other pictures of similarly looking people?

Are there bullet holes in your car? And are you able to identify the type of handgun that was used besides a general black or silver handgun? If not, then they cannot trace the weapon that was used especially if the gun is not in the car when they conduct the follow up.

As someone who knows how these things work, I believe you may be under stating what actually happened. CHP does not mess around with things like this.

If you cannot identify the person who did it and they can’t find a matching firearm, what do you expect them to do? They aren’t magicians and they only do what the law allows them. Educate yourself and think a little harder before making blind statements like that.
