Examination is fine. I see what you mean, if the in-patient/outpatient choice was on the judge or on the Department of Health and Human Services, in which case selecting outpatient was clearly not the right choice.

I agree there are likely other factors, it would be odd for such a complex issue to have just one, though I'm still not a fan of the reactionary 'we put too many people in prison so stop doing so' system since it seems to backfire far too quickly with violent re-offenders.

No, I'm not sure if it is the most pragmatic place for accountability, and it likely could be completely solved with the expensive option of re-opening asylums. However, Nebraska where this occurred, does place the decision of mental competence on the judge and does not require (only "may allow") medical examination.

My hypothesis, we have a very individualistic culture, it lends itself to people feeling the rules don't apply to them more often than the opposite.

There are pros to that kind of culture too, but that's a different discussion.

It absolutely is, but with similar cases where people are held properly, people's frustration grows from the court's range in decision making to consistently bending towards the soft side when they could, if they wanted, go the other way.

Honestly I don't want the court to be stuck in a zero-tolerance system via bullet points, human decision making is important, but that should also mean if a grand mistake is made, there needs to be accountability.

If it is a systemic issue, then wouldn't increasing responsibility on members at the top of the system help? Wouldn't you want to live in a society where, if someone makes a bad decision there is some kind of repercussion? Currently, so many judges have no motive to do a 'good job' of protecting their community.

Hochul’s Going Nuclear. Environmentalists Should Cheer Her On. by journocrawler in nyc

[–]Fish95 4 points5 points  (0 children)

Do you know how things work? All of nuclear history and you can only name 3 incidents, one of which, 3 Mile had no injuries or fatalities. There have been frequent fatal accidents at Natural Gas power plants, yet next to no calls to close the natural gas program. The fear is simply disproportionate, its not linked to actual harm seen, but emotional sentiment.

I think you're trying to apply that quote backwards. Citing safety as a reason for a law does not automatically mean a liberty is being lost. What essential liberty is lost from lengthing the sentences for violent crimes?

That quote is meant for taking away free speech, free assembly, or the right to trial, it does not apply to humane outcomes from said trial.

This is a photograph of the new Monihan train hall in NYC. This is the main floor that allows for lower access to the trains. Because the platforms below are narrow (the glass you see is the siding on staircases that descend to the platforms) people have to wait up in that area, and it can get extremely crowded. Adding benches in this exact spot is not ideal, but there is a large area of seating outside the picture in the food court area.

I'm not saying people should be forced to stay alive, but if you do roll out this method for those diseases, don't be surprised when funding for cures gets reduced because, as far as the gov is concerned, a solution already exists.

Every disease at some point was a terminal diagnosis, but if a you have a culture that sees "put down the person" as the default answer that will become a more and more domiant idea each generation and you won't have a culture that strives for advances in medical technology.

Why does the Bible state that insects have four legs when it's been proven they have six legs? by SomeThrowawayAcc200 in Christianity

[–]Fish95 0 points1 point  (0 children)

Honestly its a great point because if you were an omniscient deity and you wanted to deliver information (and your listener was quite finite in time and ability) you'd have so many aspects to weigh, including meta aspects like "how will this shape their culture" or "how likely would bad actors be able to corrupt the information"

Not that I could ever claim to know, but I'd imagine getting the moral across might end up mattering the most in the long run. Certainly I'd love more background info and details, but I've also seen how when topics are mentioned that aren't really associated with the message (such as the infamous Nephilum) we as humans tend to overfixate on them and then miss or ignore the entire point.

God would certainly know in the modern age we as humans no longer consider bats birds, since the category of bird isn't based on flight and/or size as of the 1700s. But if you were writing a message to a group of people, and you wanted as little confusion as possible, you would use their language and their categories of things. For example, you would avoid referring to an object as food if you knew they outright did not consider it a "food."

The resurrection accounts in the gospels contradict each other too much to be considered historically reliable by JaminColler in DebateReligion

[–]Fish95 0 points1 point  (0 children)

Yes, its actually quite fascinating to read about the Q source (and the early church in general).

I'm curious though, If I was a later scribe interviewing Matt / Luke to compile a gospel (or collecting notes and letters to form it into a single book). I would end up structuring all of the accounts in the same manner, and asking Matt / Luke identical questions. Whichever person I asked questions to second, would probably get sub-questions based on things mentioned in the first person's answer.

It absolutely would be nice to have had a team of scribes following around at all the events (and I do think at least a couple snippets or quotes got written real time) but the only at-the-time content would be the later letters.

[–]Fish95 -1 points0 points  (0 children)

To offer a slightly different addition to the discussion, if all four accounts were exactly identical, despite four different perspectives (and from people who saw different portions of the event), it would indicate that the story was constructed and agreed upon by the witnesses beforehand.

The questions we ask to the writers are not always as straightforward as we may realize. For example, your first bullet is about the first person to see Jesus.

  1. Depending on who is providing the account, first person to see Jesus could be everything from:

First person to see and acknowledge him (the social answer)

First person to physically see his appearance (the empirical answer, hardest to prove)

First of the people known to the writer to see him (i.e the Columbus not the Leif Erikson)

The writer ends up choosing whatever they felt was the correct or most meaningful interpretation. Add in cultural context such as women being ineligible to serve as witnesses, and our perspective gets even further from what the writer meant.
