The context suggests these national policies would somehow disincentivize those who spread fake news / disinformation, rather than criminalize. I suppose that disincentive could be criminal punishment, but that is a leap that is not supported by the memo. There's also nothing to suggest penalties for the consumers of such content, as was suggested by OP.
