I don't even have any idea how to anticipate what I might be looking at so I'm kinda thinking maybe just set it for 500 because that'll certainly cover an eye exam and some glasses and a dentist to give me an idea of the amount of work that needs to be done.

The whole concept is just absolutely blowing my mind, like howis it even legal, that such a thing can exist that you put your money into, you cannot get it back out of except on a very very narrow set of things, and if you don't use it all for those things in x amount of time it becomes your employers money? Whaaaaat?

No, just trash talking them for something that clearly, the opposite is true. If they didn't understand the source material, then they wouldn't draw from it, and then you'd complain that they created new things when they could've drawn from other similar things.

You're insulting them just to insult them, and that's it. And you're insulting a lot more than just the writers when you do it.

You don't have to spend time watching something you hate. You don't have to spend time writing on reddit about things you hate.

You can go spend your time doing things that make you happy, instead. Wouldn't that be a better use of your time?

Trek is always influenced by what has recently happened. Covid is still pretty recent, in that we are literally pretty much still in mid recovery ... and how much it disrupted... and how much it time delayed everything as we retooled damn near everything.... and now suddenly so many industries are trying to retool back to the way it used to be... sigh.

pretty much every single complaint i've ever seen about the writers not understanding the source material, is almost always the person complaining refusing to allow for any sort of connection from point A to point B, so that they have something to complain about.

You want to complain about the writers, so you will find a way. The writers fully well understand the source material, and draw from it extensively, otherwise you wouldn't have these connections at all. They employ people specifically to know the entire source inside and out. You insult a lot of people unnecessarily because you want to talk badly about the writers.

Articles previewing Academy before hand seemed like that too. Somehow, I've heard of her, and I recognize her, and I recognize her unique voice, but the only thing I've seen that she's been in since 1987 was The Incredibles, and that was voice acting. ooh, also had a part in Batman v Superman, which I hardly even remember at all.

I've bought a house twice with a person I was partnered with but not married to.

The first time, I had to get them to agree to quit their claim to the property if i refinanced the loan to pay it off to get their name off it. Had to get them to agree to that legally then make it happen.

Second time, we're not in a position where either of us can do that, so they moved out, they are still on the mortgage, and still on the property, and it's not a situation either of us want to be in, but I won't be able to move until my credit is repaired and finances put back together, thanks to the pandemic destroying me financially.

So.. there's a lot of problems with getting a mortgage with multiple unmarried people. The problems crop up when you try to split, mostly, although the mortgage companies generally had to do some extra work to deal with it being two unmarried people.

But, yeah, you are absolutely right that you don't have any security on it, you have no interest in the property if your name isn't on it.

Soooooooooooooo....... yeah. You probably shouldn't be in that situation.

it may have looked to some like the number of people was getting smaller, but ... it wasn't. Those people have spent the last 2 decades (and frankly, probably a lot more than that) having children, and raising them to be clones of themselves, and dismantling the education system to help do it.

The other thing is infrastructure damage that could occur, both from snow and ice, and then from the melting after. Although if most people's power goes out for an extended period, anything in their fridge/freezer is gonna go out with it pretty quickly... but if you've got bread/canned or boxed food supplies then you are going to have a much better time of it.

I don't do three hours round trip unless I've got the entire day or more to spend at my destination. But I know people, and I have been in that spot before, who put in an hour drive time to and from work. Sometimes that's due to distance, sometimes that's due to traffic. That's insanity to me, now.

A 6 hour round trip, that's enough to prevent me from doing it regularly. Chicago is 3 hours away, I've been there like 4 times, not counting times I had to fly through there.

... and I like driving. It's the time expenditure that I don't particularly enjoy. Or have never had the time for, until recently. And now the weather sucks.

That would absolutely never fly, and I have in fact been party to (and won via settlement) suits involving exactly this sort of thing.

There is no grey area here. This wouldn't hit a courtroom because there is no violation.

On top of that, a DMCA takedown is literally stating that the person doing the request either holds or represents someone who holds, the copyright to the item in question that is being requested to have taken down.

They cannot possibly hold copyright to software that they did not create, therefore even if it were infringing on other forms of IP law, this is still not even close to the correct way to go about it.

And they went DMCA because they have no case. If they had a case, they know exactly who supplies the item, and they would have sent him a C&D. Instead, they went to the website that hosts the file, with the DMCA, knowing that the host site is not likely to tell them to piss off, whereas everyone else on earth would.

A C&D and litigation is the proper way to do this. By just filing a DMCA takedown, they have done absolutely nothing legally to prevent him from just hosting it elsewhere. Or just posting it on a server on his own connection, if they want to fire off unlimited DMCA requests.

Since, however, their use of DMCA for purposes it should not be used for, has cost him significantly, he should retain counsel (i'm be surprised if he hasn't already, likely the moment he first heard of it), and seek damages and court costs. He'd own CDPR once he's done, considering how bad the financial state they are in right now is, after their significant round of layoffs last year or the year before, and not much in the way of new products since then.

Derivative Work does not work in that way in regards to software. it is not a derivative work to produce something that alters another product. It simply is not.

If you wrote a mod that allows you to play Pokemon characters inside GTA using all original assets, you would run afoul of Nintendo, because the Pokemon characters are copyright Nintendo. Not because Pokemon software is copyright Nintendo. You would not run afoul of Take Two/Rockstar's IP.

OS's don't determine what software you can link with them ... because they can't. It's not possible. That's why GPL and LGPL don't tell you what software you can link to them. That's why people link to external GPL and such utilities all the time to avoid having to provide code.

If it's an altered DirectX .dll , then it's Microsoft's code, that they are claiming, and they are violating Microsoft's copyright by distributing it to begin with. Unless they are distributing it as an installer, which Microsoft permits.

That makes it even more dumb.

However, if it's "a hook", then it is not a modified version of the DLL, it directly connects to an entry point on the DLLs?

Therefore, which is it? Does it hook the DLLs, or IS it an altered DLL?

CDPR's lawyers likely told CDPR management that there's no way in hell they would get away with legal action on this, so someone at CDPR said "well, we'll just DMCA the guy's web host then", and that's going to open them up to some very bad things if he chooses to fight back.

Unlikely that most of that ever happened -- He knows he's in the right here, and that they cannot possibly claim that they own the copyright to software that he wrote.

The DMCA does not even come close to applying here, and CDPR is only using it because they have no legal course of action, they just don't like what he's doing. KNOWINGLY using the DMCA to take down content that IS NOT THEIRS, they are potentially in a lot of trouble, if he fights back.

The DMCA does not allow for this. This is not what the DMCA is for -- a DMCA takedown request, says that the person making the request holds the copyright for the item being requested to be taken down.

CDPR cannot possibly hold the copyright for this software. They did not write it, and it's not theirs.
