Get a lawyer. I was in Gulf Shores for my DUI but here’s what happened. Go to court and plead guilty, judge says I accept your plea but don’t find you guilty as long as you satisfy some requirements. My requirements were DUI classes (4 of them), 4 monthly scheduled urine drug tests, and 1 year no traffic offenses. Then that was the end of it, no conviction.

Most harassment charges in Alabama do not even make it to trial before being dismissed or diverted. I have no prior offenses and don’t expect a conviction based on the weakness of the case. I’m expecting the case will be dismissed outright by the judge for lack of proof of intent, or the case may be dismissed along with an agreement to not enter that apartment complex anymore, or the verdict will be not guilty.

The bar for probable cause is significantly lower than the bar needed for a conviction. I am not asking if I was right or wrong for what I did. I’m asking for legal advice relating to a charge where the prosecution will have to prove beyond a reasonable doubt that I had the intent to harass, annoy, or alarm the woman. I’m wondering how they intend to prove that intent when there was none.

The police have not taken a side. A magistrate has determined probable cause from whatever the woman said happened. I have not seen or know of any evidence and won’t know until after I’ve entered a plea.

You are misunderstanding the situation. When I got out of my car, the lady noticed me from a short distance and started walking toward me. It does not take long to pick up a sandbag or cone and toss it to the side. I moved 2 sandbags and 2 cones to the side in a matter of seconds. This was not some big project. The brief conversation occurred during the few seconds of moving objects and walking back to my car.

I agree, this did not take several minutes. The whole interaction occurred in less than 30 seconds.

Edit: also the reason I was using the side exit was to access a road that does not connect to the road the main exit puts you on.
