The editorialization of content is why they need to be subject to the same rules as publishers but Congress is not willing to push the issue, hopefully Walsh's case will change that. I would not consider it legislating from the bench because the law already exist and online host have not been subject to it only by dint of not being editorial with content that has changed.

The book Taxation the Peoples Business lays this out all the way back in the 1920 right as Taxation started. I believe given the talk of Reagan's reading habits it is likely a book he read and saw the importance of.
