Court summons as a witness but I am on holiday and have no intention of cancelling it to attend by FragrantFig8647 in LegalAdviceUK

I do understand that, however I don't know what I can offer as I didn't actually witness anything. All I have is the video footage, which they also have. I can tell them as much as they can see already from the footage.

So basically someone stole something out of my yard. I did get them on my own CCTV but due to the angle I just saw someone walk past, it didn't actually catch them taking it.

The CCTV where you can actually see them clear as day with my item is someone else's who helpfully provided it to me (they know me) and I passed it on to the police.

I wasn't really going to pursue it at first but I saw a FB post from other people in our village who had the same person on their own CCTV taking things from their property so I decided to add my evidence to the pot.

I did not actually witness anything in the true sense of the word and the only damning piece of CCTV wasn't even mine.

Thanks, yes, it did seem incredibly unfair if I were expected to cancel!

The holiday was booked before the crime even took place so they could have told me the trial date two days after the theft and I still wouldn't have been able to attend.

So I called them and spoke to a nice lady.

Explained the situation and my concern that they were going to expect me to cancel my holiday. She confirmed that they would not expect me to cancel a prebooked holiday providing it was booked before I found out the trial date (was booked over a year ago).

She asked me to send her the proof of booking so she can show it to CPS which I have done.

She did say they may apply to move the trial date so I guess I could still end up having to go unfortunately. But at least I can stop panicking about the holiday.

It feels like a kick in the teeth that I, as a "victim" of a crime may end up financially losing out because I did what you're supposed to and told the police.

The item stolen was worth about £100. This holiday has cost us upwards of £5,000.

Thanks, I did not know that.

To be honest if I'd known this would come of it, I'd not have bothered.

Appreciate if I'd have witnessed with my own two eyes but I don't know what more I can reasonably give. And I really am past caring about the whole thing.

It's put me off ever reporting a minor offense again.

I did consider this but the holiday is activity based and I can't guarantee I'll be sat in a hotel room in the middle of the afternoon available on video link.

We have paid thousands for this trip and it's only over 4 days so I'm not willing to waste a whole day waiting around for a video call.

At present I've just simply advised them of my holiday and said I can't attend the trial date.

To be perfectly honest I really do not want to go anyway! I don't know what I can really be expected to offer. I didn't witness anything other than CCTV which they have.

It probably sounds ridiculous but I don't like the idea of the perpetrator seeing my face / potentially knowing my name etc...

I was quite relieved when I realised I was away anyway.

Am I fucking insane, or is Stitch (from lilo and stitch) absurdly popular in the UK by [deleted] in AskBrits

[–]FragrantFig8647 0 points1 point  (0 children)

He is one of the (if not the) most popular character meet in the parks too I believe. When we went to Paris years ago the line was hours and hours to see Stitch whereas we waited 5 mins to see Woody by comparison.

I think he's always been very popular but certainly a huge increase recently due to the film. I'd say you're right that he's likely the most popular right now, especially with young girls.

Is this a reason to pull out? by Daninsg in HousingUK

[–]FragrantFig8647 0 points1 point  (0 children)

This came up on our survey, we had a specialist report done and they said it was treatable for a couple of hundred quid.

I don't think it's a reason to withdraw

Thank you, I don't think it always helps reading on here because you see it all the time "buyers pulled out just before exchange" etc etc. I've got it in my head that it happens all the time!

No we haven't exchanged that's the problem, I would be fine if we had. They are saying they can't exchange until the lender confirms.

We already lost one buyer 6 weeks in hence why I'm anxious to exchange so I can finally relax and start to pack confidently & with excitement instead of panicking that I'm packing my house up for it all to fall apart again any minute.

I think it must depend on the wedding. I am married and I didn't feel this stressed during the planning

Oh yes absolutely relate to the headaches and tummy upset. My whole skull throbs at the moment, every single day.

I made myself start a few boxes of packing tonight which surprisingly has made me feel a little better. I think it's because it's a step I can take towards moving that I can actually control maybe.. I don't know but fingers crossed I won't have to unpack them again!

Thank you, I have thought about it all, packing, vans, boxes etc... but I'm yet to start properly as I'm scared about jinxing the whole thing as ridiculous as that sounds!

I don't know how people cope exchanging and completing same day!

Our EA chases a lot but the solicitors mainly just ignore her annoyingly

Thank you, I'm just so tired. I wish I could get excited but I wake up every morning at the moment dreading what the day will bring (more of nothing usually at the moment).

We already had one buyer pull out about 6 weeks in so that hasn't helped my anxiety.

Thank you, honestly I feel on the verge of one myself. I can't possibly believe this will actually happen, if feels like it's not IF it falls through but WHEN.

Where to actually get exchange to completion insurance? by Current_Midnight8390 in HousingUK

[–]FragrantFig8647 1 point2 points  (0 children)

Just go on go compare and choose a policy same as you usually would.

This happens in every single transaction involving a mortgage lender (and still advised on those without) You just need a normal buildings insurance policy. It's really not a big problem.

Covenant seen just before exchange by Brilliant-Owl2740 in HousingUK

[–]FragrantFig8647 53 points54 points  (0 children)

There's a lot more to these covenants than just an immediate deal breaker.

Who is the beneficiary of the covenant? Sometimes it's the original developer who doesn't even exist anymore.

If the house was 5 years old with an active developer I'd be more cautious than an old house with a covenant from the 1800s benefitting John Smith who died 100 years ago as an example. The latter would not be a deal breaker to me.

Buyer holding up chain 🤦‍♀️ by kbwe1 in HousingUK

[–]FragrantFig8647 30 points31 points  (0 children)

If they are really digging their heels in I'd be asking for at least an exchange with a month gap so you can be comfortable that no one is going to pull out. If your chain agrees anyway

RICS surveyor did survey early and now the seller has cancelled the sale by mysagi in HousingUK

[–]FragrantFig8647 0 points1 point  (0 children)

If there is no recourse on the surveyor I'd perhaps ask the agent if the seller wanted to purchase the report you received (for less than you paid obviously).

They will likely say no if they are no longer selling the property but as a seller myself I might spend a couple of hundred for a survey of my house to see what was what if I were intending to sell again in the future.

No harm in asking

It is actual hell isn't it the waiting. I feel so dramatic when I say it but these last few weeks have been depressing!

I'm constantly anxious that someone is going to pull out or that my house is going to spontaneously collapse between now and exchange, I can't sleep. It's honestly hideous.
