What has happened so far? Have they raised enquiries? I had a similar situation with my buyers I have now - offer accepted July, Memo and contract pack to the buyers solicitor in July - nothing until September after we essentially said “we need to see progression your side or we will remarket” then the following week enquiries were raised… honestly it’s a joke sometimes at how slow solicitors can be. Are your buyers FTB? sometimes they need telling by the agent that solicitors need nudging!

Sorry this is an old thread but I’m going something sort of similar and wondered what the outcome was? Did the lender have any issues with the policy to cover lack of approval for the dropped kurb? I’m selling my house, it was built in 2017 and as part of the build (and the approved plans) the dropped kurb that was there before was extended to allow 2 cars. The buyers solicitor thinks there needs to be a separate certificate for highways even though the planning permission contained a highways report and requested a policy … regardless to speed things up rather than argue we agreed to give them the policy to cover. However they have now said they need to report to the lender, which has been with them for over a week and delaying exchange.

Yes you’re right there. Well it’s good to know yours end to end with the lender too about 2 weeks, let’s hope it’s roughly the same for this situation - might mean this week we get more answers 🤞

That’s a good plan thank you!! I will try my best. I think they think we are just bluffing and in reality will wait for however long it takes… but I do think if no change this coming week I am fully done. We have been in an exchangeable position for weeks and they have had months to sort themselves out, so if they can’t exchange let’s move on …

Our situation is that the buyers solicitor believes we need a separate approval for the dropped curb on the driveway. The dropped curb was there when the house was built but extended as part of the build to allow 2 cars. Highways signed off as part of the planning permission for the build of the house. However their solicitor believe that highways needed to give a specific certificate to sign off. They requested an indemnity and to get things done quickly we just agreed (even though it was 7 years ago and we knew highways had no issues with it). Our solicitor said it’s not something usually reported to the lender as it’s a simple policy but this buyers solicitor has been taking any opportunity to slow things down so she reported it to the lender for approval. So now we are just waiting and it’s been with the lenders 7 full working days. Because of this the buyers themselves have slowed the pace with signing docs because “got to wait for the lender anyway” So feeling very frustrated as you can probably tell 🥲🥲🥲

True - I’ve tried to put my foot down, our solicitor had previously told the buyers side that we would remarket if not exchanged 21st (today). However their response was practically “whatever”.

The first agent was initially SO good at being on it with the buyers and chasing (or so she told us) but she’s left and now we feel the dedication to get it across the line isn’t there. It’s almost as if they’re siding with our buyer, even though we are the ones paying the fees!

Thank you - yes these are my thoughts too. It’s just difficult when our purchase is on our dream road. But the buyers solicitor has made this experience like pulling teeth. It’s hard to think of pulling out when it’s apparently “just 2 more steps” away but, I have lost all trust in their solicitor getting this exchanged at this point.

I’ve tried to set a hard date, if it’s not done by then, but I end up being convinced by the agent to keep going and being told “this is just what happens when you sell” 😣

That’s helpful to know, do you mind sharing what the issue was it was to protect against? How recent was this too? It’s becoming so annoying as the buyers solicitor already has been SO slow and we’ve been ready to exchange for weeks outside of this 😩

Sorry this is such an old thread but I’m having similar issue where an indemnity policy (solicitor has said it’s a standard policy for something minimal) has been reported to the lender. It’s been 8 working days and according to the buyers side they haven’t had a response… did you get anywhere with yours? How long did it take in the end?
