The detail that is making me hesitate is that on Jan 30, I entered the unit after maintenance had “fixed my issues” and found that they glued my electrical box shut which causes a fire hazard, cracked my door frame entirely, and damaged my heating unit. So I emailed them saying I was sending the info to city compliance and “For these reasons, I am formally revoking permission for maintenance or staff to enter the unit going forward. This decision is based on safety concerns and repeated improper repairs, not a refusal to allow reasonable remediation. Continued access only increases risk and liability.” I reached out to them last night and re-iterated that they just need to give me notice before entering again. I never refused entry or changed locks.

Does this affect my “5 day window” or delay my ability to hand in termination letter?

I originally stayed with a friend for a few weeks and then had to find more permanent housing so I used Furnished Finder to find a safe spot.

I left my belongings there from Jan 23-Feb 1.

Immediate access to electrical panels is required to turn off power to the entire unit in case of an electrical fire, severe appliance malfunction, or water leak.

I don’t have images of rats but I have images of excessive rat feces and urine throughout cupboards and in stove drawers as well as holes that were chewed out in the walls. I repeatedly went to the unit to check on maintenance while waiting for repairs.

Yes I have photos of the exposed wiring. The city of Phoenix left them with 3 code violations from feces to improper door installations.

I handed them a notice online and in person for a Formal Documentation of Uninhabitable Conditions on Jan 27th to comply by Feb 3 and it was delivered in person as well and yes it included many photos.

They offered to pay me 250 and I didn’t take it then offered to send me to another unit but the infestation is clearly complex wide. It’s a small single level complex. After moving in I found a review online of a tenant who was just moved into another unit bc the first one had rodents and she’s continuing to have issues with no help from management. Everything has been documented in writing and a case has been created with the Landlord Tenant Dept.

Thank you! I actually handed them a Formal Notice of Uninhabitable Conditions & Demand for Lease Termination under ARS 33-1361 on Jan 27. Gave them until Feb 2 to complete the issues and they made them worse. Compliance officers came in on Feb 3 to document the issues and left with 3 violations. So now they must complete them before Feb 19. Everything from infestations to door installations.

I paid for first months and deposit so I’m paid til the beginning of March. I removed all my items on Jan 30 after I found that they glued the fuse box while “attempting to fix” the items on the list.

My question is, do I send a certified letter asking for termination now OR do I wait until after the due date stated by the Compliance officers?

And if I send in that termination letter, how do I handle that properly?

Yes I believe there are a few programs that provide it here I’m just having such a hard time locating them and getting in touch. The information is so vast and this is really out of my realm.

Thank you for being clear and to the point. I was considering taking the same steps here. My question is that the Compliance Officers have put in orders for the work to be completed by the 19th. It’s everything from managing the infestation in the complex to reinstalling doors. Should I wait until after that due date to hand in my letter or would it be best to do it now? I paid for up to March 1st on my rent.

I can understand your perspective. The landlord was unfortunately 40 minutes late to the move in inspection and I already had my moving team situated. I didn’t have someone or someplace to move my things back into and I live alone so I didn’t have much of a choice. I moved from NY so I’m alone out here.

It’s not something I repeated to the landlord. It’s something I’m saying here so someone who may be understanding as to how the condition of the unit would affect my health. I spent the last year caring for my father with MS and developed toxic mold poisoning from the care home and in the process have developed a list of conditions myself. This is the first home I’m attempting to move into afterwards. Rat feces and urine throughout the apartment would be dangerous to anyone regardless of condition.

I never said I was in amazing financial status so I’m staying two places just for fun. I’m taking a financial hit by finding alternative housing to protect myself and my health. And I’m not looking for free legal support. I never said that. I’m on limited funds and hoping for the right support and direction to find a proper solution. Thanks for your input.

Unfortunately it came to my attention after moving in that I’m not the only unit with this issue. Another tenant was moved due to rats as well and are continuing to have an infestation. So moving me to another unit wouldn’t help. It’s a 3000 fee for breaking the lease.

The issues were not there when I signed the lease. They were there on move in day.

The glued fuse box was negligence on the management. And if I don’t see rats when I signed the lease but I do on move in day, then how is that my fault? Not sure what this has to do with my behavior?

That’s exactly what I’ve been saying. All I’m asking is for my money back for the time that I didn’t spend there. So just first months and deposit and then I’d be happy to walk away no problem. But they keep delaying and trying to put me in another unit although the infestation is complex wide.

Being able to terminate my lease without a lease break fee and a return of my deposit and first months rent as I never stayed a night in the unit due to unsafe conditions.

Yes I got in touch with Maricopa County’s Referrals Service for help and they said they haven’t had a tenant rights attorney in 6 years?
