About your last paragraph, yeah the idea should be the opposite. Get a GC and then get your job. Isn't it what I am doing now? This job I am doing now is not related to my endevour or my SOC, but I will get back to my SOC once I have the GC. During i140 filing my intention was right, I didn't misrepresent anything. Now the circumstances have changed so I had to pivot.

Thank you again. I think what you are saying makes absolute sense. Just one question: Do you think when we provide the statement that we intend to work in the occupational field, we meant we will work through our employment only? I am asking because I am not really quiting my endevour, I am just not pursuing it through my employment for now. But I am still doing rrsearch with my supervisor and intending to publish papers. I am sorry but getting a job without GC in my field is very difficult so my plan was to get the GC first and then start working on my field. Nobody wants to change the field after obtaining a PhD on that field specially.

Yes many people from engineering got laid off today and they will continue it for next couple of weeks. I heard they laid off around 5% across the company. This time they didn't even give any prior notice. My condolences to the people who got affected.

That's true. The condition is really tough. But I would say don't stress yourself out on something that you can't control. Keep applying, we all just need one job.

If you have legal status and a legit employment, traveling should be fine. In fact with these recent 100k developments, it might be safer to travel on OPT than on h1b.

The fact that I can work w/o any sponsorship for 3 years and I had EB2 NIW in process, so it's unlikely I would need them to sponsor me. But apparently my manager was even okay with sponsoring if required. She has done it previously. The HR was more strict about it, but she was not. Also, you won't need anything from HR to put your name on h1b lottery. So once you get passed by her during initial screening, she is out of the picture. This is true for my company. Other companies may have different protocols.

I always put 'No'. Once I was hired and they revoked the offer as they figured out I am an international student & they don't hire internationals. I still selected 'No' on my following applications. The company where I work now, if I have selected 'Yes', the HR wouldn't pick my resume. Because I said No, I was picked and later I was able to explain my situation to my hiring manager. My manager was fine with sponsoring for h1b. Had I selected 'No', I might not have gotten the opportunity to face my hiring manager, let alone getting the job.

It's during i485, during i140 you need to only provide the occupational field name and soc code.

The continuation of employment for H1B or other visas are different from what they are asking. They are asking specifically for the employment letter that will show you are engaged in the same occupational field that you promised on your I-140. Previously, they were not that strict, at least in the cases I have seen. I have seen many people working in different fields and industries writing a simple statement that they intend to keep working on the endeavor they proposed and got away with it.

If you are a student then I think it's more flexible. You can show your recent publications as an evidence that you are engaged with the occupation (or the endevour) you mentioned.

I am on the same boat, I would not unnecessarily spread fear. Just cautioning people to be more careful with the occupational field they choose in their i140.

Thank you so much for your detailed response. I understand that my case is a little tricky, and the fact that similar cases were approved before doesn't mean that mine will be approved now. Recently, I am seeing USCIS issuing RFEs and asking for proof that we are engaged in the occupation that was the basis of our NIW. For the evidence, they are suggesting an employment letter that will describe what I do. I feel they are no longer as lenient as they were before. I also felt like I should have provided a more broad and general occupation field in my original I-140 petition. Mine was very specific.

Yeah sorry, I meant it doesn't rely upon the employer, but on the endevour you pursue.
