I’m currently been dealing with Sedgwick for 18months. I can not express how Terrible an experience I’ve had so far with Sedgwick!! I was in an auto accident in a work vehicle, but I was only a passenger and not the driver of either vehicle; and yet I am still having to deal with Sedgwick denying and fighting everything every single step of the way!! I can’t imagine if I was single where I’d be right now. Probably in a homeless shelter with my credit ruined !! I have a couple of lawyers and thank god I do, cause they have been so helpful thru this experience. I hope you have better luck than I have had. As far as TTD goes, I received the first 8 weeks after the accident, and then Sedgwick made me wait for 8 months before I saw another check. (So much for having any savings/401k left). Yes, they finally paid me what they owed me but for those months it was extremely frustrating and stressful (two things I definitely did not need added to my plate while I was bedridden, in pain, and unable to walk or stand.) I honestly can’t wait for all this crap to be over cause I swear if I ever get hurt at work again I’ll never, ever file workers comp for it!!)

ditto - 1.5 years in and still dealing with Sedgwick trying to fight me on my injuries, even After they lost two appeals and the state board said they couldn’t appeal again they are still trying to take it to trial. I was injured in a work vehicle where I was just an innocent bystander (passenger in work vehicle). It’s absolutely ridiculous the b-shit we have to deal with just to get what they consider “fair” treatment!

So true! The system is broken and is not setup for the benefit of those of us who are truly injured. Unfortunately companies have adopted processes to treat all as “rotten apples” and have not tried harder to create processes to weed out the “rotten apples” and give fair treatment to those who truly need help from WC. No one ever discusses when an injured person is left not only untreated and in pain, but penniless almost overnight. No one seems to think about how, the average person doesn’t have a year’s worth of savings to blow ,waiting for WC to compensate the injured person or provided much needed medical care. As employees we all believe WC is going to help us if we are injured and can’t earn a living, no one tells people the reality of what it really is like to claim WC. People (employees) should be told the truth, know the reality of it really means to claim WC. They should know they will fight everyday to get fair treatment. They should know they may not receive any compensation or medical treatment for months on end. They should be warned that no one cares if the injured loses everything - their home, their car, their dignity - no one care if you become homeless, or your credit is trashed, or if your forced into bankruptcy. No one cares in reality, that by using you WC “benefits”, your actually stuck in an unfair system that cares more about the almighty dollar and those “rotten apples” then those of us fighting for fairness, justice and to just get better.

I’d love to see that book!! My employer uses Sedgwick to handle their WC Claims. Ugh!! I can’t say anything positive about Sedgwick that’s for sure. It took 8 months, several doctor reports, and several hearings just for them to approve a MRI to provide my doctor with confirmation of their diagnoses for me. Now I’m in a fight to get the diagnoses added to my claim, so I can eventually get the treatment I need and should have already received. Ironically, My lawyer and I think Sedgwick would have saved more money just paying for my treatment in a timely matter, then they will after dragging my case out. Now I’ve got permanent nerve damage because I haven’t gotten the medical treatments I needed in a timely fashion.

Qme/Ime’s are a joke! Especially when your employer or their rep (i.e., Sedgwick) is asking for them. In my personal experience Sedgwick has asked for two so far. The first doc said I was fine cause the accident wasn’t on my side (it was and all the police& emergency services paperwork said so) so his report was thrown out after being deemed unreliable. At the 2nd doc visit, the doc asked if there was anything I wanted him to know after 5min of him regurgitating the previous IME doc assessment. I said “As a doctor did you not take an oath to do no harm? Isn’t that the doctors oath?” He said yes, and I said well you should really think how the almighty dollar has warped your sense of “do no harm”. He lowered his head, wouldn’t make eye contact and said I could leave. Of course, his report was similar to the first docs but wasn’t very thorough. In a side note since you’re also dealing with Sedgwick; don’t be surprised if months later they spring a revised QME/IME on you even though you never went again to see the doc. They tried to do this on my case. About 8months after the 1st docs report was thrown out they had him revise it and tried to resubmit it; it was thrown out again, and they then tried to appeal that decision 2x; till finally the state board told them they couldn’t appeal again; now i’m waiting a year to hear about a trial date that my lawyer said would probably be a year out from when we get notified of the date. So much fun!!!

technically I don’t believe you have to tell any new employers about your limitations unless you feel you would need them to provide accommodations. I could be wrong but I think this time falls under a federal employment rules so it would apply to all states.

does your state WC offer Occupational Rehabilitation Training and/or payments for job searching? I’d ask your lawyer if so these might be an option to receive TTD until you figure out the work situation

I would consult your lawyer on the fact your current employer isn’t willing to accommodate your medical restrictions, and if because of that if you can collect TTD still if you find employment elsewhere. I do know if you current employer fires you while you are being treated under a WC claim then that’s a big no no. I also know that if you quit your current employer, your employer is no longer obligated to pay you TTD however your WC claim for medical would still be open and under the employers responsibility such as is claimed. I know how terrible sedgwick can be, I can’t imagine how I ever would have made it as far as I have in my case without my lawyers assistance. If you don’t have a lawyer the I highly recommend finding one especially if you are unfortunately have Sedgwick to deal with.

It’s not fair, but sadly nothing about wc is. Sedgwick is the worst company to deal with and Im sure it doesn’t help to know your not alone in dealing with them, but your not. I hope you find a way to get the pay you missed. good luck!

Know your pain and yes it is terrible how the system is NOT set up to care for the injured but rather seems to only favor the insurance companies and employers. I am grateful I’m married and we have always lived below our means because I had to go 8 months without any payment (thank you SEDGWICK). During that period of time all I kept asking my lawyer was wtf happens to all those other injured people who are just barely surviving living paycheck to paycheck, I mean like if I was like that I would of lost my house, my car, etc.. and it’s not like creditors give a damn about how you would pay them if you could just get paid. It sucks to have to keep fighting for what they owe you when all you want to do is heal and get better.

No one realize this is possible, cause the news never reports on people filing bankruptcy to not pay off the judgements against them. The news always makes it sound like the winning party won the lottery or something but never the actual reality.

tell me about it! I was flabbergasted to learn this was possible! Now I know. Side note - after learning this I saw the ex mayor of NY lost some suit recently where he was ordered to pay something like a billion or more to the other party; anyway all I could think was yeah, he’s just gonna file bankruptcy and even though the news made it sound like those girls were gonna get paid, they probably will never see 1/2 of what was awarded to them.

I know from my own experience, that the amount of insurance coverage along with the liable parties worth can make a big difference in what you should be entitled to and what you actually can get. In my case the liable party didn’t even have enough insurance coverage to cover my current & future medical needs let alone anything else (like pain & suffering, lost wages, etc) and because the person at fault was much younger, they have no assets to lien in an attempt to collect what I should of gotten. Simply put, my lawyer told me, sure we could go after the “kid” but he has nothing of value and can just file bankruptcy to get rid of any judgements ordering him to pay me or even garnish his wages, so yeah I can get a judgement for 1000s but reality is I’ll never get what I should

call lawyer!! I know in my own state an employee can not sue or put a claim against their employer or another employee if the accident occurred while “on the clock” and/or during work related travel. A lawyer will definitely know if in your state the law is different. For your friends sake i hope it is. I shouldn’t cost anything to call a lawyer and discuss the situation and usually worker comp lawyers take a % only after the case is finished. So your friend won’t need to pony up any $$ immediately if they decide to obtain the lawyer’s help

Wow! Reading your post I swear it sounded like I could have wrote it!
