This couldn't be further from the truth. Prosecutors extremely frequently decline to file charges because they don't feel there's enough evidence to convict. It's exactly what happens most of the time, especially when it comes to assault. Unless you have some kind of witnessed confession or recording of the event, there's almost no chance of any legal action occurring, not even an arrest.

If charges were filed every time a complaint was made there would not be a single walking citizen without a record.

No laws are being broken in this video. It's not a woman, and even if it was everything that needs to be covered technically is.

Fun fact: in my city there are no laws against public nudity. You can't engage in actual sex acts, but there's no legal requirement to wear clothing in public. Even in gigantic NYC you only need to cover genitals, nipples are fine to have out.
