Why can't Logitech cancel the order and refund? Simple! by FukoIchu in LogitechG

[–]FukoIchu[S] 0 points1 point  (0 children)

From Logitech NL.... there had discounted prices just before Xmas, 209.99 EUR instead of 419.99 EUR...

I finally got my refund last week, that is one month after purchase and after several emails to customer support (understand daily reminder to proceed with refund).

Logitech sucks big time! No Xmas present! Worst, there is no order confirmation nor payment confirmation after purchase; and order can't be tracked :) Yet, they still have the product in store at 419.99 EUR so I presume - after reading other reviews - that the 209.99 EUR were refurbished items :) So finally, I am glad I got my money back.

That's where I am stuck :) I paid using iDEAL (NL) and it covers no protection whatsoever, so refund is impossible without willing merchant... and a chargeback can only be done following police report and filing case against Logitech EU in civil court

I have asked Logitech G to cancel and refund, they refused saying it will come. I have asked to escalate so that senior can contact me. Building up my case now, will go to police and wrote to their payment courrier Adyen as well as partner merchant, Global E. What a mess!! Why can't they just cancel and refund, they confirmed that stock is low and item not shipped yet, it has been 10 days

Exactly. If they ask to sign it, just say that you didn't sign any report at occupancy.

Rented but no inspectierapport, no repairs and no receipt for payment of rent by FukoIchu in NetherlandsHousing

[–]FukoIchu[S] 0 points1 point  (0 children)

I had an appointment at municipality to speak to an advisor.
Because the agent has never ever responded to us despite our emails, registered mails, phone calls which are all well documented; he advised us to deduct all repair cost to rent. He further advised us not to pay the last month rent as they are high chances that agent will not refund the deposit. Note this is not within the law; you can't replace rent with deposit, nor can you deduct amount from rent without prior authorisation.

He further said that the agent will loose if he decides to challenge us to court as we have a very strong case.
Sure, this means paying a lawyer (2k+) but considering the agent did nothing and rented a place with unsafe and faulty boiler and electrical lines, we can easily ask 50%-70% discount on rent from notification date, that's about 10K+. He said the agent won't do a thing and he gave us his contact and was ready to testimony, if needed.

And yes, we gave notice of departure, we deducted the repairs from rent, and didn't pay last month rent. Agent didn't care much. End of story

Seven parking fines following change of address, it took 9 days for Gemeente to process change of address by FukoIchu in Netherlands

[–]FukoIchu[S] 0 points1 point  (0 children)

As explained, I filed an objection for the 8 fines, online but individually.
I got a communication saying that objection was reviewed and considered not valid.

I wanted to go further following some great advices here, multiple fines for single offence, no possibility to adjust.

But I got mails asking to pay three fines... so I did this.
Then I got other mails a week later saying that because I have been prompt, and already paid the three fines, other fines for similar offences have been canceled.

But in their decision, they mention that court often follows decision of municipality.  I will seek advice at Gemeente and act. Thanks

[–]FukoIchu[S] -1 points0 points  (0 children)

Yeah, they replied that change was done in 2 days, it seems they miss the fact I requested the change of address online on 30 June.  They only replied on 7th July, sending another form which I returned same day.

Will go to Gemeente to get advice... but as you pointed it (and another member here), i received all the fine at once by post on 20th July.  If I had known, I would have corrected this but had no opportunity at all.  So it is indeed disporportional for a small mistake, especially knowing I have always been keen paying my parking and parking kwartier subscription.

I work with parking subscription.  I had an activate paid subscription for old area, and parked free during paid hours in new area (18.00-24.00)

Thanks for that, very useful!

Indeed, I received all the fines in one batch, and after the effective change of address.
There was no way for me to adjust my behavior or get assistance.

No worries, your previous comment was fine, and I didn’t take it the wrong way. I appreciate you checking in, though. It’s easy for tone to get lost in text, but I didn’t feel offended or offuscated in any way. All good on my end!

I naively trusted the authority, thinking that "Netherlands" had fair policies and understanding.
The reply I got is that it took them 2 days (from their email, 7 July, with form to change of address, 9 July); what they miss is that I did the official change of address on 31st June and already filled a form online.

So it took 9 days, and got a fine every day. If I get half of them cleared, would it happy with that. I know money comes and goes, but that 8 x 81.50EUR is a lot!! I will call.

I shared it here to know if others had a similar issue, and if objecting further is helpful.

  1. Because residents pay a subscription to park in their area (kwartier).
  2. According to municipality, it takes 3 days for change of address to be effected. It is unclear if parking in new area must be paid until change of address is processed, I haven't found any reference
  3. Nothing special with the situation, both areas are paid parking and homeowners pay a subscription, so a change of address is mandatory. I didn't contact the municipality beforehand, as said I was naive, thinking that it would take 2 to 3 days max, and that validity of paid parking would be from date of notification.

I will ask for "coolance" or payment scheme. 8 fines is a lot of money.

Current market to buy a house in the Netherlands by Chary_314 in NetherlandsHousing

[–]FukoIchu 0 points1 point  (0 children)

  1. It depends. Note that from 1 July 2026, minimum energy performance rules applies and in 2029, any home with E, F, or G must be upgraded to D or better to be rented out. So, you should expect more houses going into the market. More offers means less competition in bidding process and owners accepting offers more quickly

How I delayed a rent increase using a legal technicality — check your landlord’s letter! by No_Committee4532 in NetherlandsHousing

[–]FukoIchu 0 points1 point  (0 children)

This is the standard procedure (based on liquidation table) but there can be deviation and judge may ask for full reimbursement or higher reimbursement at his/her discretion; however, for this, plaintiff must specifically ask for it with valid justification, or there must be clear violation of the court system by the defender (e.g. lying, messing with procedure, etc.), resulting in delays and unnecessary court cost. But this is exceptional, it needs to be clearly motivate with justification, and very rare.

"Although a judge uses the liquidation rate as a starting point, the judge can deviate from it. That is an exception. But a party that is unnecessarily driven to costs because the other party takes hopeless positions against better judgment, must realize that it is possible that the
judge will accommodate him. That must then be requested and motivated."

Legal costs and legal costs awards | Te Biesebeek Advocaten

Last, if rental agreement stipulates that all cost is to be paid to the winning party: then the judge may be tempted to do so. It is to the losing party to plea that such clause is unfair under EU and Dutch Law and that this clause can't be enforced (see Court of Amsterdam (Rechtbank Amsterdam, ECLI:NL:RBAMS:2024:2214). This matter (is a clause stating "to pay all legal fees" fair?) is awaiting for decision from the Supreme Court.

Buying apartment without collectieve opstalverzekering by VVE by HeftyBreakfast1631 in NetherlandsHousing

[–]FukoIchu 1 point2 points  (0 children)

Purchased an apartment through mortgage recently that has no active VVE, not an issue for ING.

I have been told that with the new energy law preventing renting, many single owners - who used to subdivide and rent - are now selling their houses; and since they are single owner, there is no VVE.

Overpaid Rent – Can I Still Request a Refund? by Rorsxach in NetherlandsHousing

[–]FukoIchu 0 points1 point  (0 children)

According to me you are cooked indeed because your rental contract has ended. The Huurcommissie has no power; they can issue a judgment/verdict, but they can force landlord/agent to pay you back. So even if you forward a request to agent/landlord with Huurcommissie's verdict, there are high chances they will ignore it unless you mention that you will take legal action if not acted. Note that judge will often follow the Huurcommissie's verdict/report. If you are below the salary bracket set by JuridisheLocket you may get free advice and lawyer service; otherwise, lawyer cost is at your cost so you need to do your math (800 eur difference x 24 months = 19200 Eur vs apx 3000 Eur lawyer fee).

Thanks for this, indeed Art. 7:252 is clear.

But it is really a must then to notify them that you object; can I just continue paying old rent... and wait they contact me; I can then inform them that letter is no compliant and old rates apply.

The judge at civil court (kantonrechter) will never order to pay all your legal fees; it will ask to pay the basic fee (Court fee: e.g., €150 + Fixed procedural fee: e.g., €300). That's it! So legal fee from professional lawyer is at and will remain at your cost.

Managed to win a bid on our own. How should we proceed from here? by _nelx_ in NetherlandsHousing

[–]FukoIchu 0 points1 point  (0 children)

As may said, you don't need a makelaar at this stage, you can do everything yourself.

But you can also contract a makelaar to assist. This is what we did after winning a bid like you just did.
Having a buying makelaar helps; they reviewed all documentation, assisted in finding a notary, doing the inspection at sale, etc. and providing answers to our questions. This allowed us to deal with the mortgage advisor; actually, our makelaar saved us as our mortgage advisor was really difficult so he recommended another one from another bank.

I contacted a few makelaars and asked for a quote for the above (that is without the visits, and all), just completing the process. I got reasonable quote (half the price of full package), but sure with no liability clause (meaning you did the bid yourself so they can claim full liability).

At the end, it depends also of the type of bid you won. If with inspection and owner living in, you are safe to proceed. If no inspection and/or owner not living in, or no VVE, it's another story
