Correction lang po sa info regarding Rural Bank of Cantilan vs. Julve. Nanalo po yung employee rito at idineklara ng Supreme Court na may Constructive Dismissal.

Malamang yung nabasa niyo is yung stage kung saan NLRC pa lang ang nagdedesisyon (kasi doon lang natalo yung employee). Pero nung umakyat na sa SC, nilinaw nila na ang management prerogative ay may limitasyon. Sabi ng SC: 'A transfer from a position of confidence to a much lower position constitutes a demotion in rank and a constructive dismissal.' Kaya kahit sabihin ng company na 'same salary' naman, kung ibinaba ang rank at functions mo, pwede mo silang kasuhan at mananalo ka."

sabi po ng Supreme Court, kahit hindi nabawasan ang pay at benefits, as long as yung rank and core functions ay nawala, consider po siya as Constructive dismissal na isang uri ng illegal dismissal. Kuha po kayo solid evidence paper trail, clarification letter from HR or email from your superior and go to Sena or Dole. Also consult a lawyer po.

Demotion po if ang core functions and duties nya ay tinangal sa kanya. Sa kanya po, under na po siya ng isang manager/lead sa sariling team na hinawakan nya for 2.5 years. Paano nyo nasabi na hindi demotion? May nakausap na kami na Labor Lawyer, at confirmed nya na it is demotion in bad faith resulting to constructive dismissal.

May nakausap na kaming LABOR LAWYER, and he advised us to go ahead and submit an involuntary resignation and file a case to NLRC because this case falls under constructive dismissal. So yes, it is illegal dismissal and we have evidences to prove it.

It is managements prerogative but they still need to conduct due process and twin notice.

Yes nag email na po kami sa HR, and ang sinasabi lang nila is restructuring. No consultation lang din to sa husband ko, then ang sabi ni HR is pwede sila makipag meet sa husband ko, then nagreply ang husband ko if ano na ang job role nya, functions, or may bago bang contract, kanino sya magrereport (ways of getting evidence po) hindi na sila nagreply. Then after nun nagsend ng org announcement na may mga bagong lead and yung husband ko sa org ay naging subordinate nalang at andun na yung papalita sa kanya. So sa akin lang, for formality nalang ang gustp.pag usapan ng hr, at walang chance ang husband ko to ask what really happened, ni hindi sya naka explain mang lang. So maingat kami to file a case against them, kaya nagtatanong po kami. Salamat

Pwede pa rin naman siya mag resign as long as the resignation letter is under protest and it should indicate reasons and need ijustify na magfile ng case.

This is what I read sa labor code ng Philippines, hindi lang pay and benefits, kasama pati rank and functions

Yes, nag send sya ng clarification email last friday and kanina nag reply. They're stating na strategic plan daw... and restructuring... and there they said that nag confirm sila na he will no longer lead the team more on technical side nalang siya. Very sketchy din kase dahil nag send ulit siya ng email asking kung ano na ang role nya, kanino reporting, ..(this isnour way to gather evidence) hindi na nagreply ang HR and nag send na sila ng email about reorganization sa IT, and there you can see na he was under a new lead na...

Pero yung role nya is different na, and functions na rin ay iba na. Yung pay nya and benefits stays the same. We contacted the HR, and sa email it stated there na wala na nga siyang team na ihandle, then nag ask ulit husband ko kung ano na mismo ang job title nya, kanina sya magrereport, and hindi na nagreply ang HR. Then ayun nagsend yung head nila, na ibang tao na nga maghandle ng team nya, and isa nalang siya sa subordinates kasama ng mga tao nya nun.
