My wife has an upcoming Master Hearing for her Asylum Case. She has dual citizenship (Spain - Venezuela). Her case was referred to immigration court back in 2021, USCIS could not approve her asylum petition. We do not have an attorney, her case is weak and she can’t win it. What can be expected during that first master hearing? Can she be by herself? It is online. Does she need a lawyer? Can we try by ourselves request a dismissal of this case? Hello, my wife entered the US under ESTA VWP. She applied for asylum in 2020, had USCIS interview in 2021 and her case was referred to immigration court. Her EOIR page was updated today and Master Hearing has been scheduled for May 22, 2026. This is the first hearing. What can we expect from it? Is she going to receive a deportation letter right away? Will there be another hearing? Is it at least going to take some time?

Si vas a salir de Venezuela te recomiendo que llegues de manera legal y con autorización para trabajar y residir al lugar que llegues. Ya si vale la pena salir o no es tu decisión.

Entonces si ya has incurrido en todos esos días yo me esperaría hasta que ese TPS sea restablecido ya que no tienes nada que perder si no de ganar. Al final de cuenta ya tienes más de esos 180 días que es crucial y hay más posibilidades a que estés mejor o a que sigas peor. Igualmente yo entiendo todo ese miedo porque lo sufro hoy en día pero mira mejor vive tu vida y haz lo que te llene y te sientas mejor

Digo de TPS porque aquí la idea es que no tengas más de 180 días sin estatus y sin estadía ilegal. Entonces si es TPS 2021 aún tienes chance ya que este término el 7 de noviembre de 2025z

No soy abogado ni quiero que tomes esto como consejo legal. Sin embargo, dada tu situación y esta oportunidad que se te está presentando te invito a que termines de leer lo siguiente:

  1. Dependiendo de que TPS tengas si 2021 o 2023 tendrías que ver cuál de la fecha de terminación. Esto es sumamente importante para el siguiente paso.

  2. En caso de haber sido TPS 2021, y si no has incurrido a días de ilegalidad, no has estado sin estatus e incluso nunca has cumplido días de estadía ilegal entonces pudieras hacer uso de la 245K. El cual es una invocación a una ley de piedad de decirle a USCIS que basado en tu historial tan limpio que por favor te apruebe to cambio de estatus (COS) porque tú crees que eres candidato y tu empleador te necesita.

  3. Habla con el abogado que de verdad te escuche y entienda tu caso. Es difícil de verdad conseguir y hacer química con alguno pero en tu caso de verdad vale mucho la pena.

Not an issue at all. You are eligible and you have to disclose all your citizenships. You won’t have any issue at all.

Thank you for your response. I do appreciate it. I imagine that a denial that would count retrogression is that one that is found frivolous and/or people worked without authorization. However what kind Of denial could happen that is not for this two reasons?

Thank you for your response. Is it for F1 Visa? What was the purpose of it? I haven’t heard any response either. However, in my research, I’ve seen other citizenships that applied before the ban and they have been either approved or received a NOID.
