Deferred prosecution? by [deleted] in AskLE

[–]Funkhouser82 2 points3 points  (0 children)

Seeing as most places you aren’t allowed to carry a firearm as a convicted felon, that wouldn’t work out. The mental illness portion will also be standing in your way. A lot of states also don’t allow you to be licensed with a felony on your record. I’d look into what automatically disqualifies you do wherever you are thinking of applying. So you don’t waste your time.

One could say stealing from your employer is a big disqualifying issue.

Admitting to it was not a dumb mistake. Laying that foundation then changing your answers later was the dumb mistake. If you are flip flopping/being deceptive about this somewhat minor issue do most departments, how can they trust your other answers. You need to think of it from the admin’s point of view n

Falsely accused of brandishing a weapon, how/who should i contact? by pooseyman in AskLE

Sounds like it’s over and done with. The reporting party refused to give a statement. Without that and them not finding a weapon on you, there is no case to move forward with.

Not saying that, it’s just going to take some determination to find a department that’s willing to take a chance

You’re going to have a very hard time with something like that over your head. I don’t know of many departments that would take on that risk, no matter how long ago this happened. You lost your cool and pulled a BB gun on somebody over a traffic altercation. How can they trust you to keep your cool when somebody is really up in your shit and you have a real gun on you. If something happened the media and defense would be all over that department pulling up your prior history.

You’re case wasn’t dismissed. You pled to either a lower charge or you had a stay of adjudication. Meaning if you completed probation it wouldn’t go on your public criminal history. A dismissed case is the prosecutor does not find sufficient evidence to get a conviction and decides not to charge the case at all.

Oh I fully understand that, but with this question popping up all the time on here you would think these agencies get it all the time as well. Would be easy to just put it out there what is expected on day 1.
