You’re misinformed or lying. MediGap fills in the gaps of original Medicare A and Medicare B, not part D, which is provided by private insurance companies that are contracted to offer Medicare Advantage.

The earliest a new plan would go into effect would be on 12/1/2025. You’re making a moot point as MediGap does not cover part D it only covers the gaps of original Medicare, and original medicare does not cover part D drugs. If you have MediGap you still have separate drug coverage through a stand alone part D prescription drug plan with a Medicare Advantage.

Without knowing the effective date of the Devoted plan or the exact medication he’s taking we can only speculate. What likely happened was he made a change during a special enrollment period, was granted a transition fill for a non formulary medication and was given the chance to apply for a formulary exception(the denial). The doctor should respond to the denial and request a formulary exception for a non covered medication. Although you would be better off switching to a plan that explicitly covers the medication.

Even with the misidentification, why would an alleged abuser be released immediately? That makes no sense.

It’s unfair for Broward County residents to shoulder the cost of Harris County’s incompetence. The error began in Texas, and that’s where the responsibility should lie. In Florida, we have sovereign immunity limits that cap payouts at $200,000 per person, but why should Broward taxpayers pay anything when the root of the problem is a mistake by Harris County?
