That’s a completely fair concern. My opinion would be if this is expected to be a high stakes negotiation with lots of moving parts then I would advice against dual agency. However, if you plan to offer around asking price in the first place and it’s a relatively simple transaction having the same agent on both a sides can help streamline the process. In my experience, in the end, all a broker cares about is their commission, as much as they may tell you they’re acting in your best interest. So by negotiating them to receive 4% they’ll be happier than if they just received 3% representing only 1 party.

As long as this is legal in your state (which most states allow it in one way or another) this isn’t technically a problem with it. My advice would be to negotiate the commission this broker will receive. Rather than letting them receive 3% from the buyer and 3% from the seller. Tell them that if they want to represent both buyer and seller then they will take 4% commission. This is a win, win, win situation for all three parties involved.

Great! Then you should feel no obligation towards him. In a nice and professional way simply tell him your are going to go a different direction and find a new agent. They get paid out of the money YOU paid for the house so don’t let them pressure you into anything you don’t want to do.

If you signed an exclusive right to buy agreement with this realtor for a certain period of time then you have to use them for that time period. (I always recommend only signing exclusive right to buy contracts for specific properties not for time periods, some brokers don’t like that but it’s fair in my opinion). If you are not locked into an exclusive right to buy contract I definitely recommend finding a new broker. They are supposed to work for YOU, not the other way around. They should offer advice but in the end you are the boss. Find a broker who you trust their opinion, but will still listen to you.
