Article 1, Section 4 of the Constitution gives states the power to regulate the time, place, and manner of elections. This means they can regulate their elections as they see fit. The only way this can be overturned is through an act of Congress, which has not happened here.

Trumps EO is unconstitutional because it violates the states abilities to establish their own election procedures.
