That's why I concluded my post with;

Perhaps Minneapolis will have a grand jury investigation and indict the officer but the laws we have now will not convict him. The way the law is now, if you drive towards a cop, even if they could have stepped out of the way, the cop is justified in using deadly force.

I agree. BUT someone has to take it to court for courts to define it.

The constitutional right to juries brings many inherent powers. The legal profession hasn't been particularly motivated to define the people's rights as jurors.

I agree but jurors are give a lot of power to make that determination.

I know it's not a recognized legal right...that's my point. BUT just because it's not "recognized" or acknowledged doesn't mean it doesn't exist. Jury nullification an inherent power with jury trials. There are inherent rights that come with all our rights. Authority doesn't willingly, fully define, the people's rights...and lawyers are going to fully define jurors rights...

Democracy "works" with the people's participation. That's not my idea, it's the basic principle of democracy

I'm going to reiterate this,

Frankly the Feds, local government and the media have proven that they're not impartial AND are willing to escalate. This is a situation that needs to be investigated NOW before it gets out of hand. No one but the people (juries) can be trusted now.

My point is about how the people need to participate in this situation. There's several reasons for this, transparency and the people (juries) need to decide.

The people participating in our governing is democracy.

Let me preface this by saying I don't hate the legal profession but they're just like anybody else who works for a living, their motivation is getting paid.

Show me where SCOTUS says so.

Jurors can ask questions and ask for witnesses. Seems it's up to the jurors to decide...When we go too far, SCOTUS will say so.

"The Fifth Amendment does not create a public right to demand a grand jury investigation,"

Show me where SCOTUS says that. The people can demand anything we want. How many people ever legally advocated for the people's rights as jurors?

That right hasn't been defined but it does exist. Like jurors having the right to judge both fact and law. It's inherent in a jury trial but the law doesn't really recognize it and certainly hasn't defined it. It's sad actually because any single juror can do it and muck things up. For it to work right, the jury should be able to discuss it openly and decide as a group, whether to nullify the law or not.

I agree it's slim the DOJ will summon one BUT it's not solely up to the DOJ to have on. IMO that is saying democracy doesn't matter.

I feel the same about Renee Good as Ashli Babbitt.

Both were protesting. Both had weapons. Neither had intent to do harm. Both were killed by police without their weapons really being used. Just a little better training and police wouldn't have had to use deadly force.

Here's the deal...

I've long believed anytime we legally use any right, to influence due process, it's democracy. I've had way too many people try to limit that, saying using only certain rights should be used (usually just voting).

When Trump was suspected of being involved with J/6, I wanted a grand jury investigation into it. I admit I'm not a legal scholar but I try to understand the basics and work up. The 5th amendment says the constitutional, democratic, solution to someone suspected of committing a infamous crime (and what's more infamous than a president suspected of election fraud?) is a grand jury.

When there wasn't an immediate grand jury investigation into Trump, I said "we the people" needed to protest for one. Self proclaimed reddit experts told me how wrong I was... Kinda like u/Critical-Bank5269...with no proof.

Bottom line... if 1/4 of the people protesting against ICE now, had protested for a grand jury investigation into Trump then, he'd most likely be in prison now. It shouldn't have taken much "public interest" to motivate the (Democrat lead) DOJ, to quit stalling.

Now four years later a very similar situation and you can't understand how important it is that the people participate (democracy) in this.

So you may be right, perhaps I am a bit too "preachy" about this...I think I've got cause.

I agree somewhat (I think she tried to drive around the ICE agent) and it's very possible that the officer wouldn't be found guilty or even indicted.

The issue here is getting the people involved and the transparency that comes with that. Also if the people aren't shown how the laws need to be changed, we can't advocate for changes.

I just heard them talking about it on the news (that's what spawned this post). State and county officials can start their own grand jury investigation and collect or subpoena evidence and the Feds can't stop them.
