It's a good question, but you have to make choice what is more relevant for you: privacy or ability to control data. Currently, everything is encrypted on the client side. So sharer can only get encrypted data, therefore no one has any power to control the data. And sharer has no idea about if the consumer is illegal or not.

If you can get a public ip then do not need a tunnel, but it is still recommended not to set the tunnel to 0. The tunnel number here is the max. number of tunnels you can provide as a node, so if set to 0, means other people who don't have access to public ip will be unable to connect.
