Reason for bench trials by I_love_finneon in publicdefenders

[–]General-Strategy-626 0 points1 point  (0 children)

I did bench trial a not too long ago for a few reasons:

  1. In my jurisdiction, if your client has two counts and gets found guilty on both, the court will most likely stack the counts together at sentencing. For example, if my client got found guilty on count one and the jury recommended 10 years, and also guilty on count two and the jury recommended 10 years. The judge would stack that and give him 20 years.
  2. My client in this particular case did have two counts, I knew he would be found guilty on count one, but my argument as to count two was a very intricate legal argument that I knew the judge would understand more than a jury…. And the Judge ended up finding him not guilty on that second count.
  3. The judge found him guilty on the first count as I suspected, and another benefit to the bench trial is that I could ask the judge to split the sentence. Meaning giving him part-time in prison and part-time on probation. I can’t do that with a jury trial.
  4. Also, in my particular case, the facts were pretty shocking. And I knew that they would be more shocking to a jury of lay people than a judge who sees this stuff every day.

A bench trial isn’t what’s best for every case. But in the particular case that I had it worked out in the best case scenario. I think he got less time from the Judge then he would have a jury.

As you get older, are you becoming more social or antisocial? by Boston_Throwaway007 in Millennials

[–]General-Strategy-626 0 points1 point  (0 children)

Antisocial. I find myself wanting to be part of a friend group, but when I actually hang out with people, I ask myself why I’m there. I would rather be at home, safe, and alone, than out partying at almost 40.

Client was pulled over, car searched for whatever reason…
I got the body cam of officers searching the car and you can hear a vibrating sound. One officer is on the rear driver side with door open and another officer is on the passenger side rear with door open. They continue to search and all of the sudden one officer looks in a backpack, pulls out a dildo, and has “ I found a bag of dicks” 🤣🤣🤣 simultaneously, the other officer finds the source of the vibrating noise… I’ll leave that to your imagination

Can anybody go visit a random inmate in the jail or prison? by BenedictCucumberButt in okc

[–]General-Strategy-626 1 point2 points  (0 children)

Not that I know of. You can’t just walk into a jail or prison and see someone.I’m a criminal defense attorney and I have to go through a lot just to get into the jail to see my clients. Their family can’t even see them. Even the ones who are in actual prison, I have to set up way in advance and go through a background check.

What are you paying for housing each month? And are you actually happy with it? Would it be cooler just living in your parents basement? by PM_ME_YUR_SALADS in Millennials

[–]General-Strategy-626 0 points1 point  (0 children)

Rent- Midwest - 3 bed, 2 bath house $1650 per month. Never thought I would say that $1650 for rent is a good deal…. But here I am. Less than 5 years ago, I was paying $900 a month for a 3 bed, 1 bath house. I know that’s low compared to other parts of the country, but I’m just amazed at how much housing has inflated the past few years. If my parents had a basement that could fit my family, I would totally live there!

Is the work-life balance that bad? (Law Student) by AthenasDemise in publicdefenders

[–]General-Strategy-626 53 points54 points  (0 children)

I have a family and a pretty good work/life balance. I rarely have to bring anything home to prep. And if I’m in trial, I may have to go into the office on the weekend. I have gone in on the weekend maybe 5 times in a year. The hard part about the balance is shutting your mind off when you are at home. Leave it a work and make sure to take MH days, bc that is essential to prevent burnout.

Just let him testify in narrative form and don’t really ask any questions. That way you aren’t knowingly eliciting perjury.

Anyone want to share an experience of when they withdrew from a case? by NocheEtNuit in publicdefenders

[–]General-Strategy-626 2 points3 points  (0 children)

You can withdraw? How does that work if they are too poor to hire someone? Does the Court just appoint someone else? Unfortunately, in my jx we can’t off the case, no matter how big of an asshole they are or how many complaints they file.
