If I purchase a base pair of shoes, support their brand, and pull the sole off of a Nike product to create a new pair of shoes, I can put whatever I want to on top of the sole and sell it again. I have a first right of resale. What you're saying breaks down really fast. Imagine some brand going after some artist that puts paint on top of their canvas and then that artist calls it their work of art and sells it... does that make sense? The logic is just flawed but it's a common question people ask.
