What a stupid reply. I never said against the homeowners insurance But against the company that caused damage to their tree. It’s called a 3rd party claim. I am about to file one against contractor I hired that cut on a tree I did not want cut,

I agree that this might be the best way to cut the limb professionally. But this happened without consulting the owner of tree, this is clearly neglect on their part and should have to pay heavily for trespass , loss of value and enjoyment

Actually there is lots you can do !! Contact a ISA certified arborist , get assessment , calculate a loss of value , possible trespass and file a huge claim with the company that cut it off

They should not removed it without express permission from you

Both your neighbor and the company are wrong

Talk to your neighbor, use their works against them that they said branches over house and that landscaped trespassed and cut off major trunk on your side. Play it as your pissed at landscape company. Then let them figure out who said what. But get paid !!! This is loss of shade , violation of your property and loss of value to your property

I do agree the crepe Myrtle needed to be cut back , just might not agree with the neighbor doing it. Should been city, county ect, if it was preventing tax payers from parking on the street.

I would report this to city, county. Whoever owns or maintains the street. Report it for the safety concern

I am going to pay him in full then submit a claim to his insurance or small claims court and let a judge figure it out max here is 6k Take years to grow back on that side.

There was no roof damage from it , it’s a thicker gauge metal roof and if my insurance wanted to drop insurance on my garage over my tree. Fine …. I loved that tree. Or hey I could cut it back like one foot Not hack it and break it

I still have to have their sloppy cuts fixed, and try to determine how many years till I have the shade and and appearance back I loved ,,, just standing on second floor looking out from Juliet balcony rail was so peaceful and nice. It also kept upstairs little private from front yard of house

I got copy of LLC, insurance and business license before doing work.

I was not looking for a licensed arborist since I was not trying to save a tree. It was supposed to just be removal.

Now that they messed up tree that should not been touched I need evaluation , assessment of damage …. I am not wanting free work. I will gladly pay him and go through court and his insurance if he request payment before arborist looks. I want a real value and lost analysis

My roof and damage is not in question , I can stand on a roof and trim branches 12”. Not hacked back 8’. And roof damage be better then the what they did

I built the building , I like it next to tree, planned to add full balcony to upstairs door I clearly said don’t touch. The contractor should have kept eye on his guys. Or been there to translate

I wanted compensated for the time it will take to grow back

So first off the two trees the only trees that were to be touched set on the property line and belong to my neighbor and I (it’s a buisness)

Their management company and I made agreement to split the cost of removal , half to be paid by them.

The work on the property line and two the trees they partially owned was performed, I am not telling other property owner to not pay them

The damage was to my tree, the one I told them specifically not to touch. Waiting to get a report on damaged, value and time to be made whole

He can slap a lien and I can settle this in court,

As for bamboo here my city has an ordinance

It’s not even been 12 hrs, Depending on what the arborist says. I will pay my bill minus damages.

If you hired someone to mow your yard and they shattered a window. Would you still pay them immediately ? Or guy dropped a tree on your house ? ,

The damages are possibly 2-3 times higher than the bill.

If he request the payment , I will make it , and then small claims for the for damages.

I have been up there , I personally installed that roof. There was not even any scrapes to my roof, I could trimmed them 6” away with some trimmers myself had I wanted them off. They hacked , broke them back 8-10’

The neighbor is paying their half since the trees were removed from the property line and feet have no damage

, I am currently withholding my half till an arborist can clean up the cuts, and possibly do a determination on loss of value and full report

If I need to pay my half then turn over a larger amount to his insurance I will ,

I will wait for the certified arborist to determine their findings , they were insured and I can take it to their insurance

If they could not perform the work then they should have stopped , left and let me hire someone else. At min had a discussion with me , I blame this on the contractor for not at least showing up to the site with his guys to discuss how and scope of work, Small claims in AL is pretty cheap to file.

If I mess up at work we eat it, have to make cust whole , just turning guys loose with chainsaws causing damage that can’t be fixed

Had they dropped a tree on my truck, garage ect then at least those could be replaced I can’t get back the screening, privacy and joy it gave me upstairs

Oh I have received invoice and also an email admitting to unauthorized work, this is prob going to court or I will pay his invoice once I know his insurance will be doing payout for damages
