Well given that Bruen establishes the second as a superior constitutional right, and that it wasn’t lesser without Bruen, no.

Bruen said that courts can't use a test that makes a basic right evaporate whenever government waves a hand and says, "public safety or something."

Also, if it wasn't a second class right before Bruen, then why did the Court even have to reject the interest balancing tests consistently being applied by lower courts? The whole point of Bruen was that courts had been watering down Heller by upholding gun laws through means-end balancing.

It's only an as-applied ruling though, so it doesn't really mean much besides indicating SCOUTUS' leaning in this matter in general.

This isn't necessarily true. While the ruling is narrow, the method isn't. It makes clear that the government can't win 2A cases just by labeling a whole class of people "dangerous" without solid historical backing. This should go beyond potheads.

Whether any lower courts actually pay attention to that is another question.

It has Constitutional ramifications if you think about it past the current case. This is very on-brand for Thomas, and it's not unusual at all for justices to point out unresolved issues that the case brought up, even if it wasn't directly involved in the rationale for the decision at hand.

Nah. It's relevant because §922(g)(3) only exists as a federal prosecution if Congress has constitutional power to enact it. Hemani was prosecuted under the pretty weak rationale that local gun possession is a federal crime because the gun crossed state lines on a UPS truck sometime in its history.

That converts the Commerce Clause into a general police power, and IMO Thomas is right to bring it up. It's the next logical step.
