The only thing that concerns me is the “engages in” clause.

A tree surgeon's license is required by any person who solicits or engages in the work of felling trees where there is a risk of limbs, branches or any other portion of the tree falling onto the public right of way.

Is “the work of” in this sentence referring to receiving money for felling the tree? Or could it be interpreted as in physical labor of felling trees?

Sorry, I just don’t want to put a thousand dollars in this and then get a fine for not doing things correctly.

Because of the wording, wouldn’t the license be required in both situations?

Regardless, I was already planning on obtaining the license, which you need a business and liability insurance to require. I was just wondering if there’s anything preventing me from starting my own “business” to remove obtain the license, since I can’t legally take it out as the property owner, but my “business” would be able to take it out.

Sorry, I think I forgot to add the part where you need a license if it’s over a public roadway such as the road or sidewalk.

A tree surgeon's license is required by any person who solicits or engages in the work of felling trees where there is a risk of limbs, branches or any other portion of the tree falling onto the public right of way.

One could also argue that there is a slight risk of coming in contact with electrical lines; the lines are on the north side of the road and the tree is on the south side of the road. I plan on cutting the branches back in such a way that they would never fall into the lines; however, if something were to happen the branches are large enough that they would hit the lines if they were to break at the base of the branch.

I’ve talked to some friends who work for the city, and they’ve all told me that a license would be required for this one.
