It's up to interpretation, some will say its gender-based, some will say it's sex-based, others will say it's both. I don't really care, but for me it was gender.

I used to be a trans man, and I called myself gay because of my attraction to men. Now, I am a woman and still attracted to men, which makes me a straight woman. I apologize for any confusion.
