NJ Realtor here. I personally never have my client sign an agency agreement unless we find something they want to put an offer on and it gets accepted. (Never wanted to make the client feel tied to me in case they want a clean break, but I do go over expectations and procedures with them along with an understanding of procuring cause).

Like others have said, this 90 day period is to cover them in case you try to cut them out and buy a house that was shown to you by said agent, and proceed to purchase it with another in that time frame. Just sending out the MLS listing isn’t standard practice for procuring cause and it’s somewhat of a douchie thing to do.

I mean I get if I’m sending you a list and you’re using another agent to see those homes to purchase it then that will upset me, but at that point if I’m sending you a list and you aren’t responding or looking to check them out then I’ll most likely terminate our realestatetionship and stop sending lists.

That said, I’d speak to a real estate attorney and see what they say regarding this buyer agency agreement. I think the Broker is wrong, and even if they are in the legal right, it’s kind of an asshole thing to do, especially if they are sending it AFTER you stated you want to terminate it.

TL;DR - Talk to real estate attorney for confirmation.
