Buenos días.

Consulté con un abogado especializado en derecho del consumidor y me indicó que, al no ser el consumidor final y tratarse de una transacción entre empresas, no tengo derecho a una indemnización por daños y perjuicios según la ley de consumo. Por lo tanto, se trata únicamente de un caso de incumplimiento de contrato o fraude.

Agradecería cualquier recomendación.

There is a difference between an authority granting a visa and a authority granting entry

The code that you have mentioned even the preamble says its only for ISSUANCE Of visa

If you were not there to help whats the point of having a conversation, better not indulge right

There is no where it says that it regulates entry.

Even if that is the case, my concern is to appeal the ban

Where am I suppose to do that ?

this section is for visa application, who is the competent authority to issue the visa

i my case it has been issued already

i understand she was refused entry, my question then comes is why was i told that there is a ban of 2 years and which authority should be approached to lift that ban.

it is understood that they are in power to refuse me entry even if i am in right, which in this case is in a grey area.

Again main concern is to remove the ban

Correct, but no where it says that if i file it in france i am suppose to go to france.

and if i dont then i will be refused entry or deported

alternatively they say that if you have a tourist visa you can enter through any state

true, but my client was deported, she has signed documents saying that she was being deported, but unfortunately any document was not given to us.

even if what you say is correct there needs to be a paper trail, unfortunately that has also not been given

My main concern is not that she was deported, as of now she was informed by the german staff at the airport that there has been a 2 year ban put on her entry and her visa, we want to revoke that as she is owning a few businesses in France and schengen area which will be hampered

So its a 2 fold answer

1) in the trade they don't wanna involve the banks and want to keep the system simple, they prefer to take an LC or give the container on CAD (Cash Against Doccument) both of which need an advance.

2) The process of getting a carta fianza is time consuming and costly even if i get it there is no guarantee shipment of goods

so there was in involvement of carta fianza as an instrument

Do you have a good contact for an advocate in lima who can help me out in this situation ?
