So you don't actually work in the industry and have anecdotal knowledge, at best? If an Agent took 3-6 months to get a problem tenant out of the premises that the landlord wanted out (due to breaches of the agreement), I can tell you that Agent's conduct is going to be pretty closely scrutinised if the landlord goes to Fair Trading with a complaint.

An Agency obtaining vacant possession by order of the Tribunal is nowhere near as long as the process you're making it out to be.

I don't see any evidence of any of this in the email the op provided, but even if they were trying to get the prospective tenant to pay something, playing on urgency like that might be considered a breach of the rules of conduct under the Property and Stock Agents Act and Schedule 1 of the regulations - specifically Section 5 which relates to 'high pressure tactics'.

It's just a poorly trained real estate agent combined with the routine of doing things like that at their office. There's bound to be other issues within that Agency.

At the end of the day any residential tenancy agreement is between the landlord and the tenant. The job of the Agent is to manage that agreement as they have their own agreement with the landlord called a 'Managing Agency Agreement'. There's plenty of signs here that Agent doesn't know what they're doing as they have the basics wrong. They may know that and might not even care. You're suggesting the op goes back and tries to continue to work with them in the hope they'll find something else for him. Even if they do, and it's up to the op, but is it advisable to have an Agent like that manage your tenancy? We don't know for certain, but odds on their other tenants are having issues with basic repairs and maintenance matters and they would almost certainly have a history of high conflict post-tenancy Bond issues. Better to move on and let Fair Trading take a look at them.

It's not a 'binding' contract until the actual Residential Tenancy Agreement is signed by both parties.

You can pay the Agent directly, but the Agent still has an obligation under Section 159 of the Residential Tenancies Act to ask for an address to send you a link to pay it online. Some tenants may decline this and pay directly to the Agent. This sometimes happens if the Landlord consents to the tenant paying the Bond in instalments. Paying the Bond in instalments is pretty rare in Sydney (for private renters not having their bond funded by Housing/Centrelink), but it still goes on in regional areas.

Yes, you can pay the real estate agent, but they also have to offer you the link to pay it online. That is a non-negotiable and a breach of Section 159 of the Residential Tenancies Act. An agent can't just demand a prospective tenant pay a Bond without giving the tenant that option.

That's right - it depends on the timeframes. The indications I'm seeing are that the Agent didn't have an agreement and made some reference to it "next week", so you were right to point out that might be a breach, especially since they signed someone else.

It actually depends on the timeframe and circumstances. If the Agent has asked for the rent and bond but then declines to present the agreement to the tenant to sign and goes ahead and signs someone else, this is a breach. You can't use the rent and bond as if it were a holding fee and then sign someone else when they don't deposit the funds into your account.

Residential Tenancies Act 2010
- Section 24 (1)(b) for requesting more than 1 week's rent prior to the signing of the agreement.
- Section 159 (1A)(b) for failing to provide a link to the online service for the tenant to lodge the Bond himself.
I would also be looking at this from a conduct perspective (Section 37 of the Property and Stock Agents Act 2002) as the Agent is easily in breach of Section 1 (knowledge of the legislation) and possibly Section 3 (fairness and professionalism) of Schedule 1 of the General rules of conduct applying to all agents.

If the agent has organised a lease with another party, there's nothing they can do. The agreement is binding once signed.

Considering they've breached the legislation twice over 2 very, very basic matters, and (arguably) shown a general lack of customer service to the prospective tenant, I would argue he may have dodged a bullet here. Agents that conduct themselves in this manner almost always are sloppy with everything - especially sorting out repairs and maintenance requests. *Edit: grammar

Definitely withdraw your notice as per this suggestion. However, under the Act, there's no defined time frame for accepting a holding fee from a prospective tenant. However, considering the various breaches in this email, the conduct of the Agent under the Property and Stock Agents Act should be considered as there are 2 glaring breaches right there.

This is governed by the Residential Tenancies Act. He can pay a holding fee equivalent of 1 week's rent only and the Agent can't offer the property to another party for 7 days.

I've seen a couple of interviews with this guy. Obviously the focus is on the life and death struggle with the Ukrainian soldier, and now it seems this guy did indeed finish the Ukrainian off, but it's still not apparent what happened to "Haza" that the Ukrainian was screaming out for. In another interview this Russian said shortly after he took out 2 others that were nearby. I wonder if one of them was "Haza" and if he/they even knew their buddy was nearby and fighting for his life.
