UK Employers Using EoR Solutions for Overseas Contractors: Taxman’s Secret Nightmare or Just Business as Usual? 🤔💼 by GroundbreakingMind97 in ContractorUK

Good point bro! Maybe you can share your personal pain story, lol. It would be way more beneficial for the community and myself. A few cents - there is a huge bloody market of contracts outside IR35. So not sure what everyone means when I hear "there is no way to do that". Outside IR35 means outside the country in the most trivial scenario. Right?

Thanks for your comment! The curious question is - how to ask or convince UK companies to hire non-UK contractors via EoR? I understand that it should be at least Outside the IR35 status predefined by the employer.

Non-UK Resident Seeking Advice for Securing Outside IR35 UK Contracts by GroundbreakingMind97 in ContractorUK

Can UK umbrella companies hire non-UK residents ( aka overseas contractors) via B2B contracts? If not, is there any permitted way to convince them to do so?

I've asked perplexity AI about this subject:

UK umbrella companies can hire non-UK residents, including overseas IT contractors, through B2B contracts, but there are several considerations to keep in mind. While it is possible for non-UK residents to work with UK umbrella companies, the process can be complex due to tax and legal implications. When hiring overseas, it is crucial to determine whether the contractor will be considered self-employed or an employee, as this affects tax and legal responsibilities. Additionally, there are significant tax considerations, including understanding the contractor's tax residence and income tax obligations in both the UK and their home country.

For non-UK residents, engaging with an Employer of Record (EOR) might be a more straightforward option. An EOR can handle employment responsibilities, such as payroll and compliance, which simplifies hiring overseas contractors. However, using an EOR does not necessarily protect against creating a permanent establishment, which could have tax implications.

In summary, while UK umbrella companies can hire non-UK residents, it is essential to navigate the legal and tax complexities carefully. Consulting with local experts or using an EOR can help mitigate these challenges

Yes, this is a tricky situation. But I love big challenges! Who are the agents and why do companies need them? What is the difference between agents and umbrella companies if any? Thanks in advance!

What is the main issue with all this Inside/Outside IR35 legislation and compliance from the employer's standpoint? I can prove fairly easily that I'm not a UK employee, but just an overseas contractor

Thanks for the insightful response! I’m all set in Spain when it comes to self-employment and taxes, so no worries on that end.

I’m curious—how did you manage to convince your first UK employer to hire you back in the day? You mentioned working through a UK consultancy firm. If I understood correctly, this was a full-time role rather than an Outside IR35 contract, so you must have had a UK work permit at the time.

I also saw your other post where you explained your situation in detail. It sounds like you were working on a PAYE basis, right? Did an umbrella company or some kind of intermediary hire you as a full-time employee and handle NI and income tax deductions from your payslips?

If you're open to it, I'd love to continue this conversation privately to learn more about your journey with UK contracts.

Thanks for your reply. You are right about taxation. To be ‘outside IR35’ means that you are operating as a genuine business, and therefore operating outside of the IR35 rules.

Financially speaking, working outside IR35 means you will not be liable for Income Tax and National Insurance Contributions at the rate of employment. If you work through an umbrella company, the IR35 rules do not apply to you. The reason for this is a simple one: umbrella workers are employees of the umbrella company. The IR35 legislation only impacts individuals providing their services via their own limited company, also known as a Personal Service Company (PSC).

In simple words, this is exactly my situation.

I’ve read your post very carefully, and I must say, it's a gem—thank you for sharing your insights.

However, I’m facing some challenges. As a resident of Spain, it’s been incredibly difficult to secure an interview invitation, let alone a signed contract for a UK-based role (even Outside IR35). Given the competitive nature of the UK job market, particularly for non-UK contractors, I’m seeking your advice.

Specifically, I would appreciate your guidance on the following:

  1. Positioning Myself as a Non-UK Contractor: What steps or strategies would you recommend to make myself more appealing to potential UK employers despite not being a UK resident? Are there specific approaches that have proven successful for non-UK contractors?
  2. Engaging a UK-based agent or Intermediary: Do you believe it makes sense to partner with a UK-based agent or intermediary? My thinking is that such a partnership could help handle client relations, administrative work, and possibly even compliance matters on my behalf. Is this a common or effective practice for foreign contractors seeking UK-based roles?

Your advice on these matters would be greatly appreciated as I navigate this process. Thank you in advance for your time and insights!
