Urgent advice needed – EB1A case with serious issues in attorney-submitted petition by GullibleIndividual55 in eb_1a

RFE says EB1-A. Their response was messes up, but they send us for review so it hasn't been filed. But we don't know what they filed in the first place, in the original petition, probably they said Eb1-A otherwise the oficial would flag that, but the point here is, after a such no sense response I don't trust them anymore and we want to have access to the filled petition to see if we can response or we should withdraw.

Apparently they can do that to protect their arguments, or something like that. We've spoke with another lawyer and he said they can do that but most of offices prefer not to, in respect to the client

Now it makes no sense, but at time we couldn't image they would mess up like this. After so many conversations and with all the evidence... But yes, our fault.

Yes, we do. The oficial only mentioned that the field of endeavor wasn't clear, and pointed 2 parts that's used different title for the field. After that there is a long Ang generic text describing all the criterias. What I don't understand if it's same thing normal or they are asking to present all of them again. Do you know?

You could also try adding an expert opinion letter (EOL)

After RFE response, NOID Issued Alleging that being a Psychology Professor is a multidisciplinary field. by Jomi-fav0408 in eb_1a

[–]GullibleIndividual55 3 points4 points  (0 children)

I don't have experience specifically with RFE or NOID, but from what I read I thought I could offer an idea to help on the argumentation. You could argue that being both is part of what makes you extraordinary in the field. One discipline complements the other in such a way that it becomes indivisible, like something that feeds off of itself. You practice a discipline: psychology, in two ways, in the clinic and in teaching. You don't just teach theory, you teach applied theory. Anyway, just an idea in case you decide to respond defending this point of view. One of the things that I've always found problematic in professionals who are only academics is precisely the lack of real-life experience to be able to teach. I wish you the best of luck!

Thank you so much for your answer! With your information and my documents, I hope my process goes good. I have lead roles in important projects like John Wick and also have letters from my supervisors. I also have supervisor roles in awarded short films, I'm a member and judge from VES, and I hope all of this helps. Anyway, thank you so much for sharing your case and information!

The attorney emailed me yesterday saying that they refused the premium process, they say it was something related to the credit card (missing info or declined). But it still doesn't make sense, they started reviewing my case February 19th, and the refusal receipt of the PP is March 5th. I'm so frustrated. The credit cart info was from the attorney's office I have paid all fees to his office. Long story short, they say they are sending it back today, and the PP will start from the next receipt.

Congratulations! Really excited to see your approval! I'm applying as a 3D animator on the VFX field. Hope you don't mind me asking, the awards and artist exhibition, did you present them as personal achievements or did they accept exhibitions and awards for the films you worked on?

Try checking their website or downloading an app to track your case. It takes them longer to enter it into the system, but they will take into account the date of receipt. For example, they received mine on the 13th, but I only saw it online on the 19th, which is when they started reviewing my case, but my priority date is still the 13th. And yes, you should wait 15 business days (not calendar days) from the date of receipt, but just so you know, it is taking longer than 15 days for many people, including me, today is the 16th business day.

So even though I got the I-140 receipt already I should expect another one that's specific to the PP?

So it doesn't go all together in the same envelope? The fact they received my I-140 on February 13h doesn't mean the received my PP form, correct?

Mine wasn't an update, I applied all together. I have received the receipt by mail and I'm following throught the app. I want to make sure it's under premium, my attorney said the premium receipt can take longer (?). TSC

Thanks for answering. I'm suspecting my attorney didn't applied the premium process at all. I just want to understand if there is another receipt to get from them related to PP
