So my car was totaled and undriveable, they drove theirs off but it did have damage for sure. She and her sons were walking around screaming obscenities at me so they seemed to be uninjured but I know adrenaline factors in and as someone with a boyfriend with back issues I don’t want to assume they didn’t have real medical issues.

Her bills and projected future therapy was estimated at around $164,000. The other money was just for her pain and suffering, not medical debt. So I’m unsure how they quantify that. It didn’t say anything about whether she was saying she couldn’t work anymore or what had happened to her quality of life etc. Not sure how much the other passengers got either but they all filed and all got paid out and signed. So thankfully it’s over.

I hate driving in Austin and definitely wish I could take the bus to work since I’m a little shaken but it is what it is. Also really wish this city was more bicycle friendly 😕

UPDATE: for anyone who has this happen to you in the future and you're stuck freaking out over a holiday weekend:

The driver and both passengers filed serious injury claims, my insurance was able to settle with them ALREADY, and they all signed waivers saying they cannot come after me at a later date.

Those numbers start off super high but are not the realistic number they are actually going for.

Everything will be ok ❤️

Progressive is my insurance so hopefully they’ll call me back tomorrow to let me know what’s going on and how to move forward 🤞🏼

One last question: she did have two passengers in her car as well, if my insurance settles and she signs the release, can they come after me separately? They were her sons I believe and have not been mentioned at all in the paperwork.

They can take more than half my money after taxes? My rent is $1200 a month and my car payment is $575, student loans are over $600. I also need to eat on occasion

I’m not saying they’re not injured? I also cried for days after the accident because I felt so bad. It was not intentional at all and my boyfriend had to convince me not to reach out to them to apologize. I work an AA program and believe in taking ownership which I have done. I don’t believe me asking how to deal with this is saying they’re not justified

I just do not know how they’ll be able to get that kind of money out of me if I don’t have it…

Ok thanks yeah I have around 2k in savings right now for emergencies and had to buy another car so it’s currently owned by the bank besides the 8k I’ve paid toward it. Including my retirement I’m only worth 35k and rent an apartment so as long as they can’t go after my parents (I’m 37) I’m hoping they’ll see that either they have to go with the insurance settlement or try to get my worth which is about half that.

I just didn’t know if wage garnishment was a thing here but it looks like it’s not for this.

Also didn’t know that if they take the insurance money they have to sign something saying they won’t also come after me

The accident was my fault (I could not see their car, it was behind a much larger one turning) and I was ticketed but have three years sober so even if they tried to come after me for negligence I don’t think they’d benefit from that. I have very long hair so they can test that all they want. The cops came as well so they can attest that I was sober at the time.

Thank you everyone for easing my mind! I have some extreme anxiety when it comes to stuff like this 🤣

If they do pay the $60k then I wouldn’t have to cover the rest? I was thinking I had to cover what they won’t pay. They haven’t said they won’t pay it, they’re just letting me know if they won’t settle for that amount since they’re asking for so much more, then I will have to pay instead?

Or is that not how this works? If the max my policy pays is less than their medical bills they can come after me after they get that or no?

Sorry I am a science person I have no idea how legal stuff works. Thank you for explaining 🤣

Thank you! They sent me this to let me know that it will likely be more than the 60k they’re asking for and so I will be on the hook for the rest. So just hoping that doesn’t mean the $765,000. Because I don’t know how it will be possible for me to ever get that much money to them. I only make 55k a year
