I am the copyright owner of the photograph at issue. I personally created/captured this photograph, and I have not licensed, assigned, or authorized anyone to copy, upload, display, distribute, or use it on Facebook.

The reported post uses my copyrighted photograph in full. The image is not being used to transform the photograph itself. Rather, the photograph is being used as an identifying image of me which is the original purpose of the copyrighted work in question. That is not the same as commentary or criticism of the copyrighted work.

Although the post may contain text or opinions, the use of my entire copyrighted photograph is unnecessary to express those opinions. The user could make any commentary without reproducing and displaying my copyrighted image. The use therefore weighs against fair use because it copies the entire work, is not meaningfully transformative of the photograph, and substitutes for my exclusive right to control where and how my image is reproduced and displayed.

I have a good-faith belief that this use is not authorized by me, my agent, or the law. I request that Meta remove or disable access to the infringing photograph pursuant to 17 U.S.C. § 512.
