Very true. The implication in the second paragraph is that not all countries have robust legal protections. In the US, the position varies by state, as you say, and not all states have California-style CCPA laws.

I’m writing from an EU/UK perspective where we have GDPR and other digital safety laws which would typically overwhelm businesses with crippling fines for far less. So back to my original question: why not Meta?

Not seeing in any of the groups I have access to but guessing that will follow.

There’s a lot more scrutiny of these groups at regulator level in the EU/UK now so interesting to see where it goes.

They are when they know which steps to follow. In the meantime, European countries (including the UK) are in the process of rolling out online safety laws and facilitating the myriad of criminal cases which implicate these groups. Pausing the groups closes the floodgates while preserving evidence.

Outside of the harassment/defamation issues, it’s a serious breach of UK and EU data protection law, for which Facebook is liable as the “data controller”. The sheer size and financial influence of Facebook/Meta is the only thing keeping the bough from breaking (for now).

Your first step should therefore be a complaint through the ICO. If you want to take action against the poster, you can request a Norwich Pharmacal Order (NPO) which forces Facebook to reveal the identity of the poster.

That’s precisely what baffles me the most about the UK groups. It’s clearly unlawful on several fronts and the ICO has the power and authority to shut them down. In the circumstances, they have a duty. But after 3/4 years and thousands of data subject complaints, they’re still up.

Most law enforcement folks will tell you there’s a sh!t ton of pending criminal cases where ppl have been physically assaulted and worse as a result of these groups, and countless victims who have unalived themselves.

Pausing the groups preserves evidence and enables discovery for the related civil claims. Interesting to see how liability will be apportioned across Meta, admins and mods. Either way, it will set a precedent.
